R$ 2,01 mil millones (US$324 millones) por el derecho de operar en el sector al Gobierno Federal de Brasil.
En total, 15 ordenanzas otorgaron autorizaciones definitivas a 14 empresas. Una de ellas recibió más de una ordenanza de autorización debido al número de marcas que pretende operar: cada autorización puede contener hasta un límite de tres marcas, y se requiere una nueva autorización para operar otro grupo de tres marcas adicionales. Una ordenanza adicional para el sector (Ordenanza SPA/MF Nº 2.104) presenta a 52 empresas que han obtenido autorizaciones con carácter provisional para operar en el mercado de apuestas de las “Bets”. Estas autorizaciones fueron otorgadas a empresas que ya cumplieron con los requisitos, incluido el pago de la subvención de R$ 30 millones (US$4,9 millones), pero tienen subsanables cuestiones pendientes, que pueden ser corregidas, tales como documentos relacionados con la certificación del sistema de apuestas, juegos online y la integración de estos al sistema, o la necesidad de complementación adicional de documentos o información.
Las empresas con autorizaciones provisionales tienen un plazo de 30 días, prorrogable por otros 30 días (si presentan las justificaciones necesarias presentes en la ordenanza), para entregar los certificados técnicos obligatorios, como los de seguridad de sistemas de juego y servidores tecnológicos. Si no cumplen, se les podrán suspender las autorizaciones hasta por 90 días y si persiste el incumplimiento, se les revocará la autorización de manera permanente, impidiéndoles operar reglamentariamente en el país. A partir de este ayer miércoles primero, todas las empresas autorizadas a operar a nivel nacional deben cumplir con todas las reglas, incluida la de operar exclusivamente en sitios web con el dominio “
bet.br”. Durante un período de adaptación, los dominios “
com.br” seguirán en funcionamiento, pero no podrán ofrecer apuestas a los clientes. Las instituciones financieras y de pagos ahora tienen prohibido realizar transacciones que tengan el propósito de realizar apuestas de cuotas fijas con personas jurídicas que no hayan recibido autorización. Aquellas empresas que no estén autorizadas, pero que continúen teniendo dominios activos que ofrecen servicios de apuestas de cuotas fijas se consideran ilegales y serán bloqueadas.
Las empresas de la primera lista inicial son las que conforman el grupo de las que presentaron sus solicitudes hasta el 20 de agosto de 2024. Las solicitudes realizadas con posterioridad a esta fecha quedan en revisión y, según la normativa vigente, deben tramitarse en un plazo de 150 días desde la entrega de la documentación inicial. En el caso de las empresas que solicitaron la autorización y no cumplieron con los requisitos, se produjo una desestimación, contra la que cabe recurso administrativo.
Según el Secretario de Premios y Apuestas del Ministerio de Hacienda, Regis Dudena, Brasil comienza 2025 con apuestas deportivas reglamentadas bajo control estatal y con reglas claras, resultado del esfuerzo del Ministerio de Finanzas y del Gobierno de Brasil. “El país ya está dando un paso fundamental para atender los posibles problemas asociados al sector con la finalización de la regulación, así como la finalización de la primera ronda de autorizaciones, colocan las apuestas de cuotas fijas ofrecidas en todo el país bajo control estatal. Comenzamos el 2025 con reglas estrictas y claras, así como mecanismos para exigir su cumplimiento con total responsabilidad por los operadores autorizados. La imposición de estas normas y su implementación son el resultado de un esfuerzo gigantesco de los servidores del Ministerio de Hacienda, bajo la dirección del ministro Haddad y del presidente Lula”.

In total, 15 ordinances granted official authorizations to 14 companies. One of them received more than one authorization due to the number of brands or sites it intends to operate: each authorization is allowed up to a maximum limit of three brands, and a new authorization is required to operate another group of three additional brands.
An additional ordinance for the sector (SPA/MF Ordinance No. 2.104) shows 52 companies that have obtained provisional authorizations to operate in the betting market. These authorizations were granted to companies that have already met the requirements, including the payment of R$ 30 million (US$4.9 million) licence fee, but have pending issues that can be corrected, such as documents related to the certification of the betting
system, online games and their integration into the system, or the need for additional complementation of documents or information.
Companies with provisional authorizations have a period of 30 days, extendable for another 30 days (if they present the required justifications stated in the ordinance), to deliver outstanding mandatory technical certificates, such as those for the security of gaming systems and technological servers. If they do not comply, their authorizations may be suspended for up to 90 days and if the non-compliance persists, their authorization will be revoked permanently, preventing them from operating in the country. As of yesterday, Wednesday 1st of January, all companies authorized to operate nationwide in Brazil must comply with all regulations, including operating exclusively under “
bet.br” domain. During an adaptation period, “
com.br” domain companies will continue to operate, but they will not be able to offer betting products to customers. Financial and payment institutions are now prohibited from conducting transactions that have the purpose of placing fixed-odds bets with entities that have not received authorization. Companies that are not authorized but continue to have active domains that offer fixed odds betting services are considered illegal and will be blocked. The companies on the first approved list are those that make up the group that submitted their applications up to August 20, 2024. Applications made after this date are under review and, according to current regulations, must be processed within 150 days of presentation of their initial documentation. In the case of companies that applied for authorisation and did not comply with the requirements, thy face an official refusal, with the possibility of an administrative appeal.
According to SPA Chief, Regis Dudena, Brazil begins 2025 with regulated sports betting under state control and with clear regulations, which is the result of efforts by the Ministry of Finance and the Government of Brazil. “The country is already taking a critical step to address the potential issues associated with finalizing regulations for the Bets sector, as well as the completion of the first round of authorizations, placing fixed odds betting on offer across the country under state control. We begin 2025 with strict and clear rules, as well as mechanisms to enforce them with full responsibility from authorized operators. The imposition of these rules and their implementation are the result of a gigantic effort by everyone at the service of the Ministry of Finance, under the direction of Minister Haddad and President Lula.”
