PERU Se aprueba Ley del juego online y apuestas deportivas a distancia


El Congreso de la República aprobó la ley que regula la explotación de los juegos y apuestas deportivas a distancia, a mediados de julio, según un comunicado emitido por el Ministerio de Comercio Exterior y Turismo, (MINCETUR) cuyo titular, Roberto Sánchez, dijo que la actividad debía ser regulada porque “nadie debe generar actividad sin tributar”.


Como se sabe, los juegos y apuestas deportivas a


distancia mueven alrededor de US$ 1 000 millones, sin rendir ingresos al erario nacional. Por ello, con esta aprobación se estima que el fisco peruano podrá recaudar S/ 160 millones (US$41 millones) anuales para ser invertidos en la reactivación del turismo, además en obras de infraestructura pública y promoción del deporte. El texto de la ley aprobada en el


Congreso de la República indica que el Mincetur es la autoridad administrativa a nivel nacional que regula, autoriza, revoca, fiscaliza y sanciona la explotación de los juegos a distancia y apuestas deportivas a distancia. Además, el texto dicta que se


prohíbe la participación en los juegos y apuestas deportivas a distancia de los menores de edad y personas con ludopatía, identificadas a través del Registro de Personas Prohibidas a Acceder a Juegos de Casinos y Máquinas Tragamonedas. En el caso del otorgamiento de licencias de funcionamiento a locales físicos, las municipalidades únicamente podrán otorgar licencias a los titulares de salas de juegos de apuestas deportivas a distancia previa autorización por el Mincetur. La ley también establece que las salas de juego de apuestas deportivas a distancia no deben encontrarse a menos de ciento cincuenta metros, siguiendo el mínimo recorrido peatonal, de templos o centros de educación en donde se imparta educación básica regular. Asimismo, se bloquearán las plataformas ilegales que no tengan autorización nacional. Del mismo modo, se instituye la constitución de garantías a favor del Estado para cubrir el pago de multas y premios contra los infractores; además, se plantea un impuesto directo aplicado al Ingreso Neto (Net Win) del 12% (mismo porcentaje que la actividad de casino y máquinas tragamonedas), entre otros.

PERU – Congress approves online gaming and sports betting legislation


In mid-July the Peruvian Congress approved, by a large majority, legislation to regulate the exploitation of online games and sports bets, according to a press release from the Ministry of Foreign Trade and Tourism (MINCETUR). Minister Roberto Sánchez said that this activity should be regulated because “no one should generate any commercial activity without taxation.” It is well known that remote sports games and


betting move around US$1 billion in the country, without yielding income to the national treasury. Therefore, with this approval it will be possible to raise some S/160 million (US$41 million) per year for investment in the reactivation of tourism, in addition to public infrastructure works and promotion of sports. According to the approved legislation, Mincetur is the administrative authority at the national level to regulate, authorize, revoke, supervise and sanction the exploitation of online gaming and sports betting. Additionally, the text also prohibits participation by children and people suffering from problem gambling duly identifi ed from Mincetur’s registration on the matter. Granting of operating licenses to physical premises will be done by the local municipalities, following Mincetur authorization. The law also establishes that remote sports betting gambling halls must not be


located less than one hundred and fifty meters away, following the minimum pedestrian route, of temples or education centres where regular basic education is provided. On the matter of foreign and illegal sites, the


government will block operators, and for any infractions of the law the legislation constitutes guarantees in favour of the State to cover the payment of applicable fines. Also, there is provision for a direct tax to be applied to the Net Win of 12% (same percentage as the activity of casino and slot machines), among others.
