Advocates Argentum For You


State legislatures across the country are ex- tremely motivated and eager to actively pass legislation while the federal government faces gridlock in the U.S. Congress. Each year thousands of pieces of legislation get introduced at the state level with the hopes they will move throughout the state cham- bers and make their way to the governor’s desk for signature. However, not every bill moves toward passage. In early April, there were over 120,000 bills introduced and only about 4,000 of those bills will get signed into law. Over 40 states are currently in session


and a few states wrapped up their legis- lative agendas. With the assistance of an advanced legislative tracker, Argentum’s public policy team is able to identify which bills impact the senior living industry and analyze the likelihood of a specific bill passing out of committee. Almost 600 bills have been introduced at the state level that may impact the industry and those we serve. Of those 600, the Argentum team has identified about 60 bills that are extremely important to the industry and before April, saw five legislative initiatives become enact- ed, including these measures in Kentucky, Virginia, and West Virginia (right):


Kentucky » KY SB 4 Establishes a medical review panel


system for use in civil litigation relating to healthcare providers, including assisted liv- ing and personal care home providers.


Virginia » VA HB 1919/VA SB 1991 Increases the ag-


gregate amount of civil penalties that the Commissioner of DSS may assess against an assisted living community for noncom- pliance from $10,000 per 24-month peri- od to $10,000 per 12-month period.


» VA HB 2301 Allows licensed practical nurs- es (LPNs) to administer vaccinations.


» VA SB 1434 Allows employers to hire an applicant or continue to employ a person convicted of one misdemeanor barrier crime not involving abuse or neglect if five years has elapsed following the conviction.


West Virginia » WV HB 2167 Creates a silver alert pro- gram for seniors.
