New Argentum Report Analyzes State Building Regulations for Assisted Living


A


rgentum is offering a 115-page report “Building Regulation and Assisted Living: A National Analysis Report”


to educate the industry about the web of regu- lations throughout the states and to offer sug- gestions for better state agency coordination.


Development and Construction Key to Industry Expansion Removing barriers to development and construction plays a key role in enabling assisted living to continue its expansion well into the 21st century as the industry faces widely varying development and construction requirements throughout the country. The report identifies different ways each state regulates how an assisted living community can be built. The analysis is limited to identifying basic state licens- ing agency regulations for designing and building an assisted living community, and how those criteria correlate or conflict with separate state building and life safety code requirements. The analysis indicates that in some states,


lack of coordination and correlation be- tween different state agencies makes build- ing an assisted living community one of the more complex design and building process- es. The purpose of this analysis is to allow interested parties to use the information to bring more uniformity with less potential conflicts within a state when designing and building an assisted living community. It includes data on communities generally


serving 10 or more residents. Communi- ties serving fewer residents generally have different code classifications and fewer requirements. The report includes a chart detailing regulatory bodies’ licensing regulation and


enforcement for new construction. It sum- marizes the findings of licensing regulation, basic National Fire Protection Agency Life Safety Code and International Building Code comparisons and criteria and the rat- ings of coordination between state agencies and the complexity of their enforcement.


Report Helps Navigate State Regulatory Bodies Many states have up to three intrastate agencies regulating assisted living and unfortunately some states have little or no coordination between these regulatory bod- ies. However there are fully coordinated and correlated states. The report reviews both types and notes the following characteris- tics of states and their oversight of assisted living construction. » Gaining a license to develop, build and operate an assisted living community is always required through a state licens- ing agency.


» Each local jurisdiction or state also


enforces a separate building code that may or may not be coordinated or cor- related with the state licensing agency regulations.


» Some states also enforce another sep- arate building code through their state licensing agencies or through their state fire marshal’s office. There have been conflicts for assisted living in meeting state requirements outlined in different officially issued versions of the Interna- tional Building Code as well as the sep- arate National Fire Protection Agency Life Safety Code 101. In turn, the IBC and the NFPA also pose conflicts for compliance between versions of each of those codes.
