This Fair season, more than 5 million residents and visitors will experience one of Florida’s most authentic cultur- al traditions: its Fairs and Livestock shows. Packed with fun, food and festivities, these events take place in just about every community through- out the state and highlight Florida’s rich and diverse heritage.

Florida’s Fairs provide a tremendous opportunity for visitors to learn more about Florida’s agriculture industry, its impact on the state’s economy and its role in feeding our nation. But the Florida Department of Agriculture and Consumer Services partners with


Florida’s Fairs and the livestock community to provide more than agricultural education – we also work to improve the safety of the Fair’s rides.


The department works in conjunction with the more than 250


amusement parks and 175 traveling Fairs and shows in Florida to uphold the highest standards of safety. Every year, the depart- ment conducts about 9,500 inspections of amusement rides at permanent parks and seasonal Fairs to help create a safe envi- ronment for Florida’s residents and visitors.


Currently, the department is developing a new program that


uses historical data of ride inspections to identify trends in amusement ride breakdowns, malfunctions and problems. With the ability to identify trends, we can partner with ride operators and manufacturers to determine solutions. This new process represents our commitment to do everything we can to prevent reoccurring problems, better protecting all fairgoers.

“Illegal Gambling” Section 616.09 of the Florida


Statues specifically prohibits a fair association to allow illegal gam- bling on its fairgrounds. The Florida Statutes provide in pertinent part:

Nothing in this chapter shall be held or con- strued to authorize or permit any fair associa- tion to carry on, conduct, supervise, permit, or suffer any gambling or game of chance, lot- tery, betting, or other act in violation of the criminal laws of the state; and nothing in this chapter shall permit horseracing or dogracing or any other pari-mutuel wagering, for money or upon which money is placed. F.S. 616.09.


In the event a fair association allows illegal gambling on its


fairgrounds, the penalty is forfeiture of the fair’s charter. However, there are forms of gambling which are declared


legal in the State of Florida and are outlined in Chapter 849 of the Florida Statues (ie. bingo, drawings by chance, game pro- motions, etc.). Accordingly, it is important to note that if a fair association intends to avail itself of any of the exceptions con- tained in Chapter 849 of the Florida Statutes, or allows an enti- ty or individual to do so, that fair management ensures that they are in compliance with the laws governing gambling in this State.
