I AM DRAWING UP MY WILL AND WOULD LIKE TO LEAVE MONEY TO A CHARITY – WHAT DO I HAVE TO DO?


Making a will ensures that your friends and family are provided for as you intended and that your wishes are respected after you have passed away. It is also an opportunity to remember other things that are important to you, such as a favourite charity. Your solicitor will be able to advise how best to achieve your wishes. Remember that gifts to charity are exempt from inheritance tax, so there may be tax advantages to including a charitable legacy in your will.


WHAT TYPES OF LEGACY ARE THERE?


Tere are three different ways to make a gift in your will, either by means of a residuary, pecuniary or specific legacy. ● A residuary legacy is where a person leaves a percentage of their estate to charity. One of the advantages of this approach is that it has the benefit of being inflation-proof and means you are less likely to need to update your will in the future. ● A pecuniary legacy is a gift of a fixed sum of money. ● A specific legacy is a gift of a particular item of property – for example land, paintings or jewellery.


WHAT INFORMATION DO I NEED TO INCLUDE A BEQUEST TO A CHARITY IN MY WILL?


Your solicitor can advise on specific wording for the type of legacy appropriate to your circumstances. You will need the full name of the charity and its charity number. In this case, it is the Scottish Youth Hostels Association (Scottish Charity No SC013138), 7 Glebe Crescent, Stirling FK8 2JA.


I ALREADY HAVE A WILL. DO I NEED TO INSTRUCT A NEW WILL IF I WANT TO LEAVE A GIFT TO A CHARITY?


Making changes to an existing will is simple. It can be done by means of a Codicil. Your solicitor will be able to advise you how to do this and provide you with the appropriate document.


SHOULD I ADVISE A CHARITY OF MY INTENTION TO LEAVE A LEGACY?


Tere is no need to do this. After all you may decide to change your will before your death or your circumstances could alter. However, if you would like to share your personal reasons or story as to why you have chosen to benefit SYHA, they would love to hear from you.
