We guarantee that the seeds we sell conform to the label description, as required by State and Federal Seed Laws, within recognized tolerances. We make no other guarantees, expressed or implied, of merchantability, fitness for purpose, or otherwise, of the seed or the crops grown from the seed, other than germination. Our liability, for the breech of this guarantee, whether contractual, for negligence, or for any other reason, is limited to either a credit voucher for the purchase price or replacement of such seeds, either act of which shall constitute full and complete adjustment and release. As a condition to any liability on our part, we must receive notice of any apparent. Several states (AL, AR, FL, ID, IL, IN, MN, MS, ND, SC, SD, TX, WA or any other states which adopts arbitration or mediation before maintaining a legal action based upon failure of the seed sold to produce as represented. You must file a complaint (sworn if applicable), with any applicable filing fee, with the State Commissioner / Director/ Secretary of Agriculture within such time as to permit in- spection of the crop by us and designated agency. If this guarantee is not acceptable, then the seeds must be returned at once in the original unopened container, and the purchase price will be refunded in full.
