SHIPMENT OF YOUR ORDER – Seeds and garden supplies (non-live merchan- dise) are usually shipped promptly upon re- ceipt of your order. Nursery stock/perishable goods/live plant ma- terial is/are shipped as close to planting time as possible, and not prior to March 1st due to the danger of freezing in transit. Only limited nursery stock will be shipped after June 1st.

Prices in this catalog are effective December 15, 2011, and supercede all previous prices. Shumway reserves the right to correct or change prices without notice. Separate ship- ping & handling charges apply to each shipping address.
GUARANTEE
We guarantee all items in our garden cata- log to be as represented within recognized tolerances. Any seeds, bulbs, trees or plants which fail to grow will be replaced one time or a credit voucher issued at our discretion provided we are notified in writing prior to September 1st following the date of ship- ment. Sale items will only be issued a credit voucher for the purchase price. We guarantee only items that are planted properly. We can- not be responsible for poor cultural practices, drought, flood, insect damage, rodent damage or neglect. Gardening Aids and Hardware items are guaranteed against material and workman- ship defects. Report any unsatisfactory mer- chandise item (non-growing item) within 30 days of receipt. We may ask you to return it for inspection prior to any refund, voucher or credit being issued. In no case will we be liable under the above GUARANTEE for any amount greater than the purchase price; the refund or replacement shall constitute full and complete adjustment and release. Several states (AL, AR, FL, ID, IL, IN, MN, MS, ND, SC, SD, TX, WA, or any other state which adopts arbitration or mediation laws) require arbitration or me- diation before maintaining a legal action based upon failure of the seed sold to produce as rep- resented. You must file a complaint (sworn if applicable), with any applicable filing fees with the State Commissioner/ Director/Secretary of Agriculture within such time as to permit in- spection of the crop by us and any designated agency. If this guarantee is not acceptable, then the seeds must be returned at once in the origi- nal unopened container, and the purchase price will be refunded in full.

NOTICE ABOUT OUR SEEDS AND THE LAW. Shumway seeds are tested to ensure that they meet or exceed U.S. government standards. The packets are color coded to in- dicate various seed lots. Vegetable and flower seeds are shipped untreated except in rare in- stances when only treated seed is available.
NO GENETICALLY MODIFIED SEED OR PLANTS are knowingly sold by Shum- way. They are defined as mechanical transfer of genetic material between genera, families or kingdoms.

HARDINESS ZONE MAP
This USDA map divides the country into plant hardiness zones based on average lowest winter temperatures as shown in the chart. Zone boundary lines are not absolute. Temperatures and wind chills can vary. You should consider local conditions like hills, valleys, rainfall, wind, snow coverage and soil. For instance, a certain plant may survive fine in Zone 3 in Maine, but not in North Dakota, simply because of differenc- es in rainfall, wind chill or humidity. So be flexible. Use this informa- tion as a guide when local information is not available to supercede it.
