Gremio emplaza al Ejecutivo sobre regularización de bancas ilegales
La Federación Nacional de Bancas de Loterías mediante acto de alguacil emplazó a las autoridades a culminar en su totalidad el Plan Nacional de Regularización de las bancas como lo establece el decreto 63-22 y la Resolución 061-22 del Ministerio de Hacienda, según el medio Noticias Sin.
El ejecutivo dominicano has sido públicamente emplazado mediante acto de alguacil emitido el 06 de septiembre 2024, y de no tener respuesta, se anticipa que se ejecutarían las acciones legales establecidas a daños y perjuicios que pueden enfrentar los dueños de bancas, puntos de ventas y agencias de loterías adscritas a Fenabanca. Fenabanca insiste en que las autoridades deben implementar un plan agresivo para la fiscalización y clausura de bancas ilegales, que no cumplan con los requisitos pautados, y ante dichas irregularidades por parte de las autoridades, los consorciados de Fenabanca rechazan la forma arbitraria e improvisada por parte de funcionarios, quienes sin tener la más mínima preparación u orientación exigen se haga efectivo un plan de interconexión. El documento del gremio dice: “Estamos solicitando y demandando del Ministerio de Hacienda, del Viceministro del Tesoro, de la Directora de Casinos y Juego Azar, del Director General de Impuestos Internos, y del administrador de la Lotería Nacional y coordinador del Plan de Regularización y de cualquier otra autoridad que, por mandato de ley, tenga responsabilidad de fiscalizar y organizar el sector de juegos”. De acuerdo a lo establecido en el Decreto 63-22, se establece que se concluya de forma satisfactoria el Plan de Regularización del sector Bancas de Loterías, estableciendo los protocolos para determinar las bancas, puntos de ventas o agencias que califican para otorgar las licencias de operación. Esto respetando los 200 metros de distancia que debe existir entre una banca legal y otra.
“En Fenabanca y Asociaciones de Loterías de diferentes provincias, no rechazamos la interconexión, nuestra oposición se avoca a la manera arbitraria, desinformativa, desorganizada y sin criterios claros se quiera imponer un plan de interconexión cuando no se tiene control ni siquiera de las bancas que operan de manera irregular en el país”, reclama el gremio.

Fenabanca summons the Executive on illegal lottery retail vendors
FENABANCA – Federacion Nacional de Bancas de Loteerias, of the Dominican Republic, through a bailiff act provision, has summoned the country’s Executive to finalize in its entirety the National Plan for the Regularization of “Bancas’ – lottery retail vendors - as established by decree 63-22 and Resolution 061-22 of the Ministry of Finance.
What this means is that the Dominican executive has been publicly summoned by means of the Bailiff’s Act, issued on September 6, 2024, and if there is no response, it is anticipated that legal actions for damages to the licensed owners of bancas, points of sale and lottery agencies attached to Fenabanca would be executed.
Fenabanca insists that the authorities must implement an aggressive plan for the inspection and closure of illegal bancas, which do not comply with the established requirements by law, and in the face of such irregularities on the part of the authorities, the Fenabanca businesses reject the arbitrary and improvised form by officials who, without having the slightest preparation or guidance, demand that an online interconnection plan becomes effective. Fenabanca says: “We are requesting and
demanding from the Ministry of Finance, the Vice Minister of the Treasury, the Director of Casinos and Gambling, the Director General of Internal Taxes, and the administrator of the National Lottery and coordinator of the Regularization Plan and any other authority, that by mandate of law they have responsibility for supervising and organizing the gaming sector.” In accordance with the provisions of Decree 63-22, it is established that the Regularization Plan of the Lottery Bancas sector is satisfactorily concluded, establishing the protocols to determine that bancas, points of sale or agencies are qualified to be issued with operating licenses. All this, with provisions for the necessary 200 meters distance that must exist between one legal banca and another.
“In Fenabanca and Lottery Associations of different provinces, we say that we do not reject online interconnection. Our opposition is the arbitrary, misinformative and disorganized way, without clear criteria, to impose an online interconnection plan when there is no control even of the bancas that operate illegally in the country,” claims the guild.
