Telecommunications Undersecretary Claudio Araya said the government is preparing to permanently block illegal online gambling sites in Chile, although he sees it as “unlikely” that the gambling public will receive any sanction, adding: “The focus is on the bookmakers.” The only thing we can say is that it is time for legislation to be approved in Chile enabling the remote gaming sector to operate legally. Gobierno reglamenta el juego online y las apuestas deportivas
¡Una gran noticia! Así empezó el contenido de la nota de prensa oficial, temprano el viernes 13 de octubre, cuando el ministro de Comercio Exterior y Turismo, Juan Carlos Mathews, resaltó la publicación del Decreto Supremo N° 005-2023-MINCETUR, que aprueba el Reglamento de la Ley Nº 31557 modificada por la Ley N° 31806, que regula los juegos a distancia y las apuestas deportivas a distancia pues constituye una norma de vanguardia en el país, que tiene como premisas la seguridad para el apostador, el juego responsable y la formalización de la actividad. La norma establece que entrará en vigencia en 120 días, esto es el 9 de febrero 2024. Durante los siguientes 30 días, entre el 10 de febrero y el 10 de marzo 2024, todas las empresas operadoras de las plataformas tecnológicas que ofrecen estos servicios deberán presentar de manera virtual al Mincetur su solicitud para que se les otorgue la Autorización de funcionamiento.
Aquellos que no se registren en ese periodo, no podrán seguir operando en nuestro país, y la sanción para aquellas operadoras que no cumplan con esta disposición, será no menor a 150 UIT, y además será pasible de denuncia penal correspondiente, conforme al artículo 243-C del Código Penal vigente e inhabilitación para ejercer esta actividad. En ese sentido, todas las empresas sin distinción sean nacionales o extranjeras deberán adecuarse a la nueva regulación y cumplir con el correcto pago del impuesto especial al juego, que a partir del mes de abril de 2024 se empezará a aplicar para los

Executive Government regulates online gambling and sports betting
Great news for Peru! exclaimed the official press release, published early on Friday 13TH October. Minister of Foreign Trade and Tourism, Juan Carlos Mathews, highlighted the publication of Supreme Decree No. 005-2023-MINCETUR, which approves the Regulation of Law No. 31557 modified by Law No. 31806, that regulates distance gambling and remote sports betting, with cutting-edge standards in development for the country with the firm premises of security for the betting public, responsible gaming and the formalization of the activity. The Law states that published regulations will come into effect in
120 days, that is on February 9, 2024. During the following 30 days, between February 10 and March 10, 2024, all the operating companies of the technological platforms that offer remote gambling and sports betting services must submit their application via online to Mincetur to be granted the Operating Authorization. Those who do not register in that period will not be able to continue operating in Peru, and the sanction for those operators that do not comply with this provision, will be no less than 150 UIT*, (PENS 742,500.00/US$194.000), and will also be subject to the corresponding criminal process in accordance with article 243-C of the Penal Code, which can force disqualification to exercising this activity. In that sense, all companies without distinction, whether national or
foreign, must adapt to the new regulations and comply with the correct payment of the special gaming tax, which from April 2024 will begin to be applied for remote games and remote sports betting, at the rate of 12% on net profit.
