A la fecha se encuentra en vigor el resultado del Referéndum Popular del 7 de mayo de 2011, donde los electores ecuatorianos aprobaron por mayoría la prohibición de los negocios de juegos de azar, que es vinculante en la actualidad. En vista de lo anterior, todas las licencias y permisos de juego y apuestas son nulos, y ninguna autoridad puede emitir válidamente registros, licencias o permisos para actividades civilmente ilícitas.
IMPLICACIONES PARA OPERADORES DE PRONÓSTICOS DEPORTIVOS Y GAMING El pronunciamiento de la PGE tiene relevancia directa para quienes operan en el sector de pronósticos deportivos y gaming en Ecuador. El propio Reglamento para la Aplicación de la Ley Orgánica para el Fortalecimiento de la Economía Familiar establece que las actividades de pronóstico deportivo
no habilitan la prestación de servicios de juegos de azar como casinos, bingos, loterías o apuestas en general. Así, aunque un operador de pronósticos deportivos opere bajo un marco regulatorio específico, la extensión de su oferta hacia actividades que configuren juegos de azar en sentido estricto lo sitúa en el ámbito de la ilicitud civil, y potencialmente penal, sin que su licencia deportiva le sirva de cobertura.

SPECIFIC IMPLICATIONS FOR SPORTS BETTING AND GAMING OPERATORS
The PGE ruling has direct relevance for businesses operating in the sports betting and gaming sector in Ecuador. The Regulations to the Family Economy Strengthening Act expressly state that
sports forecasting activities do not authorize the provision of gambling services such as casinos, bingo halls, lotteries or wagering in general — whether physical, digital or through any other means. Accordingly, even if a sports betting operator holds a specific regulatory license, extending its offering to activities that constitute gambling in the strict sense places it squarely within the scope of civil — and potentially criminal — unlawfulness. A sports forecasting license provides no cover for such activities.
