British Gambling Regulation – 2022 roundup

ne year ago, I opened my article for the January edition of Casino International with the line “2022 looks set to be a seminal year for gambling regulation in Great Britain”. Of
course, the anticipated White Paper from the Government has not (at least at the time of writing) emerged. Nevertheless, 2022 has seen fairly significant changes to gambling regulation, notably the Gambling Commission’s updated customer interaction requirements for remote operators and the Advertising Standards Authority’s updated rule and guidance regarding advertising which has “strong appeal” to under 18s. The majority of the Commission’s new customer
interaction requirements for remote operators came into force in September 2022, although a last-minute decision led to two requirements and the implementation of the Commission’s new guidance being delayed until February
2023. Those requirements that have come into force include a set of indicators of harm which must be used by licensees, an expectation that all licensees will use automated processes to monitor for and act on signs of harm and increased requirements for evaluating the effectiveness of their approach. The delayed items are those requiring operators to taking action in response to signs of vulnerability and prevent marketing to, and the take up of bonus offers by, customers displaying strong indicators of harm. The new advertising rule, which came into force in
October 2022, states that gambling adverts must not have strong appeal to under 18s, irrespective of their appeal to adults. In particular, this prevents celebrities and influencers popular with under 18s being used to advertise gambling, unless the advertiser can ensure under 18s are excluded from viewing the advert.
