ARGENTINA – Laudo obliga a Salta a pagar US$36 millones a Casinos Austria


El Centro Internacional de Arreglo de Diferencias Relativas a Inversiones emitió su fallo en el caso de arbitraje que se originó el 18 de diciembre, 2014 por Casinos Austria International GmbH con Casinos Austria Aktiengesellschaft contra la República Argentina, por la disputa entre la provincia de Salta y la fi lial local de los austriacos, Entretenimientos y Juegos de Azar SA (Enjasa), obligando a la provincia argentina a pagar la suma de US$36 millones en reparaciones a Enjasa por la decisión “arbitraria y abusiva” en la rescisión del contrato de operaciones de juegos de azar. El laudo emitido del pasado 5


de noviembre, 2021, estipula que la decisión del Tribunal del ICSID por reparaciones a favor de Enjasa se basa en la decisión de la rescisión del contrato de licencia de operaciones de esta última en el año 2013, por ser la empresa, licenciataria de tómbola, lotería, juegos en vivo, casinos y juegos de mesa en toda la provincia, La rescisión del contrato entre la provincia y Enjasa, que llevó a cabo


durante la gestión del exgobernador Juan Manuel Urtubey, fue fuertemente rebatida por Enjasa desde el inicio con apelaciones que llevaron a Casinos Austria a invocar un convenio de promoción y protección de inversiones fi rmado por Argentina y Austria en agosto de 1992.

ARGENTINA – Award forces Salta to pay US$36 million to Casinos Austria


The International Centre for Settlement of Investment Disputes – ICSID) has ruled on the arbitration case that began on December 18, 2014, between Casinos Austria International GmbH and Casinos Austria Aktiengesellschaft against the Argentine Republic. The ruling on the dispute between the province of Salta and the local subsidiary of the Austrians, Entretenimientos y Juegos de Azar SA (Enjasa), states that the Argentine province has to pay the sum of US$36 million in reparations to Enjasa for the “arbitrary and abusive” decision terminating the gambling operations’ contract. The award, issued on November 5, 2021,


stipulates that the Tribunal ruling for reparations in favour of Enjasa for the Salta Province was based on the decision to terminate the latter’s operating license agreement in 2013, as licensee of tombola, lottery, live games, casinos and table games throughout the province. The termination of the contract between


the province and Enjasa, which was carried out during the administration of former governor Juan Manuel Urtubey, was strongly refuted by Enjasa from the beginning, with appeals that subsequently led Casinos Austria to invoke an investment promotion and protection agreement signed between Argentina and Austria in August 1992.
