del Poder Legislativo el adjunto proyecto de Ley, mediante el cual se lo faculta a través de la Dirección General de Casinos (DGC), a explotar directamente el juego on line, así como a autorizar dicha modalidad de juego a aquellos que previamente hubiesen obtenido la concesión o permiso de explotarlo en forma presencial.” Según el Artículo 1ro y sin prejuicio de previa legislación, facultar a la DGC a“prestar la actividad de juegos de casinos tales como póker, ruleta, slots, entre otros, creados o a crearse, bajo la modalidad “online”, a través de internet, plataformas tecnológicas, aplicaciones informáticas o similares. “La actividad de juegos de casinos bajo la modalidad


establecida en el inciso anterior, podrá ser prestada directamente por la Dirección General de Casinos del Ministerio de Economía y Finanzas mediante el sistema tradicional o por las operaciones vigentes que funcionan bajo el denominado sistema mixto”.


BRASIL – GT publica primer borrador de Ley de Juegos de Azar


El Grupo de Trabajo de la Cámara de Representantes para el Marco Regulatorio del Juego en Brasil presento, el 24 de septiembre, el primer borrador del documento que actualiza el proyecto de ley PL 442/91. El nuevo proyecto fue presentado por el vocero, diputado Felipe


Carreras, para su debate sobre la estructura, organización, lineamientos y normas principales del marco regulatorio de juegos y apuestas, y aunque no representa necesariamente la opinión definitiva del GT o de los involucrados, está sujeto a nuevas modificaciones con el objetivo de llevar a cabo un debate sobre el texto inicial por otros legisladores antes de que sea presentado al presidente de la Cámara de Diputados, Artur Lira.


El documento detalla, en el Art. 8, las modalidades de juegos y


apuestas autorizadas, tales como juegos de casino, bingo, la lotería ilegal jogo do bicho, apuestas de cuotas fijas, apuestas en carreras de caballos y juegos de habilidad. El borrador inicial no define los modelos de casinos que operarán en


Brasil, o si se permitirán casinos solo en resorts integrados, pero por el entendimiento inicial es que serán permitidos los casinos urbanos, ya que lo único que el párrafo del art. 8 define es: “La práctica y explotación de juegos y apuestas podrá tener lugar en un establecimiento físico o virtual, previa obtención por parte del interesado de los actos de consentimiento de los Poderes Públicos, de conformidad con la presente ley”. El documento establece que


las entidades del turf - o Jockey Clubs - podrán explotar sus propios productos de apuestas de carreras de caballos y también los juegos de casino y bingo, y los ingresos de estas actividades serán exclusivamente para el beneficio de los objetivos sociales de la entidad. El documento define la creación del Sistema Nacional de Jogos e


Apostas – Sinaj, que estará compuesto por organismos reguladores federales, operadores de juegos y apuestas, entidades del turf y agentes de juego y apuestas, así como firmas de auditoría y entidades de autorregulación del mercado.

established in the previous subsection may be provided directly by the General Directorate of Casinos


of the Ministry of Economy and Finance through the traditional


system (state run) or by the current operations, operating under the so-called mixed system”.


BRAZIL – GT publishes Gaming Law to replace 1991 white paper


The House of Representatives Working Group (Grupo de Trabajo – GT) for the Regulatory Gambling Framework in Brazil published, on 24th September, the first draft that updates white paper PL 442/91. The new draft was presented by spokesman Rep. Felipe Carreras, for


debate on structure, organization, guidelines and main rules of the gambling regulatory framework. Although it does not necessarily represent the definitive GT opinion or those involved, it is subject to further amendment. The objective of the initial basic text is for debate by other legislators before presenting the final draft to the President of the House of Representatives, Arthur Lira. The document lists, in Art. 8, games modalities and authorized


bets, such as casino games, bingo, illegal lottery jogo do bicho, fixed odds betting, horse racing bets and skill games. The initial draft does not define the models of casinos to be


deployed in Brazil, or whether they will be allowed only in integrated resorts, but the initial understanding is that urban casinos will be allowed, as the sole paragraph of art. 8 defines that. However, the document


states that horse racing entities – or Jockey Clubs - will be able to exploit their own horse racing betting products plus casino and bingo games, with the revenue from those activities exclusively derived for the benefit of the entity’s social objectives.


The document also sets out


the creation of the Sistema Nacional de Jogos e Apostas – Sinaj, (National Gambling and Betting System – Sinaj), to be composed of federal regulatory bodies, gaming and betting operators, turf entities and gaming and betting agents, as well as auditing firms and market self-regulation entities. In addition to Sinaj, Rep. Carreras also proposed the creation of a National Register of Players and Bettors, with a view to ensuring control of the activity from the player’s point of view.
