7 Copyright 7.1 Copyright ol all artwork, copy or other material created, reworked or contributed to t^ the Company shall vest in Ihe Company. 7 2 The Advertiser authorises the Company to record, reproduce, publish, distribute and broadcast (or to permit the same) all advertisements (includ­ ing but not limited to text, artwork and photographs) and to include and make them available in any tnlormation service, elecUontc or otherwise. 8 Advertiser’s Property Held at Advertiser’s Risk All artwork, photr^raphs, dm or other property deliveted by the Advertiser to the Company is held by the Company at the Advertiser’s nsk and the Advertiser should insure all such property against loss or damage whatso-' ever cause, the Company reserves the right to destroy without no(ce ail artwork, photographs, dm or other property which has been in its custody tor six months from the dale of its last appearance in an advertisement, unless the Advertiser has given wriflen instructions to the contrary. 9 Box Numbers 9.1 The Company will endeavour to forward all replies to a box number, to the Advertiser, as soon as possible aker receipt, but the Company accepts no liability in respect ol any loss or damage alleged to have risen through delay in torwarding or omiOinq to forward such replies, howsoever caused. The Advertiser authorises the Company to examine material passing though boxes and to return to its originator any conrmunicarion which, in the opinion ol Ihe Company, should be delivered to the Advertiser. 92 Advertisements from dealers are not accepted under a box number. - 10 Right to Disclose Information 10.1 All advertisements must be accompanied by thcAdvertiser’s full name and address. All trade advertisemenis must contain a trading name. 10.2 The Company reserves the right to refuse an advertisemenl contain­ ing only a mobile telephone number unless the Advertiser dscloses to them a BT land line number (or similar).

11.3 In no circumstance shall the Compan/s total liability (including con­ sequential liability) in respect ol any error, misprint or omission exceed either the amount ol a lull refund ol any price paid to Ihe Company lor the advertisement in connection with which liability arose, or the cost ol a fur­ ther or conective advertisement ol a type and standard reasonably com­ parable to that in connection with which liability arose.


11.4 The Company shall not be liable lor any loss or damage (including consequenSal loss or damage) occasioned by any total or partial failure lor reasons beyond the Compan/s control ol publication or distnlxition ol any newspaper, edition, supplement thereof or other publication in which any advertisement is sdteduled to appear.


12 Assignment


12.1 The Company shall be entitled to assign its contract with theAdver- liser or any ol its rights or benefils thereunder to any other company within the group ol Johnston Fress pic,

ORDERS FOR THE INSERTION OF ADVERTISEMENTS ARE rrOOEPTEDSUBJECTTOTHE FOLLOWING PAVMENTTERMS

12 Ihe Advertiser’means any person or company placing with the Com­ pany an orderTor the publication ol an advertisement in any ol the Compa­ n/s newspapers, or other publications.


2 Rates


2.1 The rales charged lor the insertion ol advertisemenis shall be those set out in the Compan/s rate card in force at the time the order is placed. The rate card is subject to change at any time and may vary between Com­ panies and publications within the Johnston Press pic group of titles. Copies are available on requesL


22 It is Ihe responsibity of the Advertiser to bring Ihe Compan/s attention at the time ol booking any discount, allowance or exemption from Value Added Tax to which entitlement is claimed.


23 All gross advertising rates (except classified lineage and semi display). are subject to the Advertising Standards Board ol Rnance (ASBOF) levy from time to time (currenlly 0.1%) payable by the Advertiser to help fnance the sell regulate^ system.


3 Advertising Agencies


3.1 Commission will only be granted to agendes lormally re< Ihe Newspaper Sodely or the Company at the (me ol pfadng the order. The rate of commission payable will be determined by the Company any may be varied or withdrawn at the Compan/s discretion at any (me, sub­ ject to giving the advertising agency seven days written notice thereof.


32 All advertising agendes daiming commission must quote order num­ bers lor every booking made.

3.3 The Company reserves the right to vary these terms ol acceptance ol advertising and payment in resped ol any advertising agency at Ihe Com­ pan/s discretion, subject to giving the advertising agency seven days writ­ ten notice thereof. .


4 TimeolPaymenl


4.1 Pre-payment may be required lor any advertisemenl at the Compa­ n/s discretion.


42 Save as provided tor under Clause 4.1 above, payment shall be made lot each adverrtseraenl within seven days ol the date ol the invoice, except that payment ol advertisements charged to an approved credit account shall be made no later than thirty days after invoice. Should the Advertiser be in breach ol these terms, or ol any contract with Ihe Company, then the full amount in rasped of all advertising published and all other antounts accniinglromtheAdvertisershallbecomedueandpayable. ,


4.3 The Company reserves the right to withdraw credit fadliSes from any Advertiser at the Company’s discretion subjed to giving the Advertiser seven days written notice thereof, it practicable, or torthwith upon the issue ol any Court proceeding against the Advertiser.


4.4 All payments must be accompanied by Ihe remittance advice issued by the Company.


4.5 Any query in resped ol an invoice must be brought to the attentioii ol the Company within seven days ol its issue.


5 LatePaymenls . . '


5.1 The Company shall be entitled to charge interest on all sums due at a rate of 2% above the base rate lor the time being ol Lloyds Bank Limited until payment is received, after as well as belore any judgment is obtained.


52 The Company shall be entitled to add to any sums due any reason­ able costs and expenses (induding administrative costs) incurred by the Company in obtaining pap eni thereof on an indemn% basis.


5.3 The Company shall be entitled to charge the Advertiser £15,00 in resped ol any cheque tendered which is not met upon presentation (and to vary this charge at any (me without notice).


5.4 The Company reserves Ihe right to exerdse a lien over any documents or other property ol the Advertiser in its possession it the Company’s charges ate not paid in accordance with these terms and the Company’s rale card from (me to (me.
