Attack youth’s ‘unduly lenient’ sentence upheld


A SABDEN labourer who robbed a 16-year-old and kicked him in the face with steel-toed boots after a “binge drinking session” escaped jail despite his community sen­ te n c e b e in g d e cla red “ u n d u ly


lenient” by a top judge. Daniel Guirham (18), of Whalley


Road, Sabden, robbed Martin Lafranceschina outside his home on November 5th last year, after mistak­ enly believing he had made off with alcohol he had bought for him from a supermarket. Guirham pleaded guilty to robbery


when he appeared at Preston Crown Court on February 23rd this year and was sentenced to 80 hours’ community punishment, plus a one-year commu­ nity rehabilitation order. That sentence was referred to Lon­


don’s Appeal Court by the Attorney General, Lord Goldsmith QC. Lord Justice Scott Baker, sitting with Mr Justice Walker and Sir Douglas Brown, ruled that it had been “unduly lenient.” However, the sentence was not


increased, because of Guirham’s good behaviour since the offence and a legal technicality which would render an increase unfair. Guirham’s friend, Simon Thompson


(21), also involved in the incident, pleaded guilty to unlawful wounding and was given 80 hours’ community punishment and a two-year probation order. Lord Justice Baker told the court

A SIX-YEAR-OLD Clitheroe hoy is believed to be the youngest in the country to be awarded an amateur radio licence. Pendle Primary School pupil


Morgan Roe has become the envy of his friends after picking up the high-ranked title. For the past eight weeks, Mor­


gan, of Bawdlands, has been attending Burnley Radio Club to obtain the foundation licence. In order to qualify, he had to sit a 25 multiple-choice examination, based on what he had learned on the course. The test included questions on


maths, English, science and elec­ tronics. In addition, he had to pass radio and electronics theory and the Morse Code exam at five words-per-minute. Morgan’s parents have always


encouraged his love of radio and are proud of his latest achieve­ ment. His father, Lee (40), who runs Phoneworks, in Eshton Ter­ race, has played a big part in helping his son achieve the award.

tuitous and excessive violence” used in the attack, “which took place in a pub­ lic place, with a motivation of retribu­ tion and revenge, outside the victim’s home and follomng a session of binge drinking.”


“Binge drinking is a recurrent prob­


lem and will be dealt with severely by the courts,” he went on, “and we have come to the conclusion that this is a case of an unduly lenient sentence and the judge should have imposed an immediate custodial sentence. Howev­ er we consider that it could not be appropriate for us to impose a custodi­ al sentence today.” He explained th a t , to increase


Guirham’s sentence would be unfair as i t would create a “disparity” with Thompson’s sentence. A legal techni­ cality prevented Thompson’s commu­ nity sentence being reviewed, he said. The judge added that Guirham had

radio has expanded Morgan’s vocabulary. “He has been able to communi­


cate to people around the world and make new friends. We are extremely pleased \vith him.” Mr Martin Durkin, founda­


tion course instructor at Burnley Radio Club, said he was surprised at the knowledge and expertise demonstrated by young Morgan. He added: “He has done


extremely well and I believe he is the youngest in the country to achieve the foundation licence, although this has yet to be con­ firmed.” The licence has enabled him to


go “on the a ir”, thanks to an amateur radio station installed in his home and communicate with people around the world on a fair­ ly low level of power. Looking ahead, Morgan will be


following in the footsteps of his father and working towards his intermediate licence, with the prospect of eventually going for the advanced licence.

Tatham Bridge, the clouds s ta r ted to disperse and the ground was still fairly dry. Lunch was taken with fine


views over the fells to the east and south and Melling to the north. At least 80 wild flower species


were noted including woody night shade, gipsy^vort, smooth hawksbeard and crow garlic. Descending to the “Motte


and Bailey” by “Loyne Bridge”, the rivers Lune and Wenning were followed to Hornby and Wray. The next walk is to Warton
