FEED IN TARIFF (FIT) A CALL TO ARMS


The current threat to the Feed in Tariff (FiT) may be averted.


Keith Brooks of Horizon Power Ltd has examined the reports from DECC and suggested a solution to the crisis on his Linkedin profile as a post. This was picked up by the country`s leading QC on the matter who has confirmed that whilst the approach is rarely used it could, in this case, be a way forward.


QUIA TIMET INJUNCTION Rather than a judicial review the suggested plan is to issue a Quia Timet injunction to be lodged against the government at the High Court of Chancery – this injunction would prevent all planned reductions in the current level of support for all renewable energy types.


Such an injunction is also known as a ‘Freezing Injunction or Prohibitory Injunction’. One of the rules that applies is that the respondent (DECC) must provide the applicant with all the data held on that matter. This would allow a team representing industry to work with DECC from quantifiable data.


The application group will be developed and run as a Not-For-Profit Community Interest Company (CIC).


ENCOURAGING GOVERNMENT TO WORK WITH COMPANIES Mr Brooks, the instigator of the initiative has expressly stated that “The principle is not to form an anti-government CIC but to create a situation which encourages the government to work with companies within the renewables industry to develop a secure, workable programme that the government will be bound to uphold until 2050.


“The last consultation regarding Pre- Accreditation received 2372 responses but was pushed through in 4 weeks, with this in mind what weight will the responses to the cuts in the FiT hold. Sadly I am not alone in thinking that any consultation paper is just a procedural inconvenience.


“What is needed is something tangible to encourage the government to sit down with us and work out a workable solution, I believe an injunction that freezes the current rates would create such encouragement.”
