When Harford County wished to run sewer easements across the plaintiff’s land by agreement, the plaintiffs agreed pro- vided that Harford County would permit the plaintiffs to tie into a certain public sewer system. Subsequently the county refused to live up to this agreement. As a result, a lawsuit was filed and a settlement agreement was reached, in which Harford County again agreed to permit the plaintiffs to tie into the specified sewer system. Harford County refused to comply with the agreement settling the lawsuit by permit- ting the plaintiffs to tie into the sewer system. This matter was raised with the Circuit Court which ruled in favor of the County, finding that the County officers were without authority to agree to provide sewer service to the property in question. On appeal, the plaintiffs raised the issue that the agreements were enforceable as a matter of law and that the doctrine of equitable estoppel or applies against the County to preclude the County from even arguing that the agreements were not enforceable.
