The bill received strong opposition from IWIF and the defense bar, as well as vari- ous employer interests. The bill was not voted by the Finance Committee.
Lead Paint – Market Share Liability
HB 746 and SB 660 – Lead-Based Paint Damages – Reimbursement by Manufac- turer – Market Share Liability While MTLA’s legislative team and its
lobbyists were not charged with drafting the proposal, MTLA devoted a portion of it efforts to working with a coalition of proponents seeking passage. The bills would have established liability of man- ufacturers for damages linked to lead paint based on their share of the market. While defining how to determine market share at any point in time, as well as over a period of time, continued to be a
focus of opposition to the bill, substan- tial strides were made this Session in educating legislators about the nature and extent of the problem. While the bills failed, one needs to recognize that dramatic innovations to tort law take a number of years before passage.
