The 2007 session of the Maryland
General Assembly underscores just how important a governor’s race can be. Shakespeare says it best, “O brave new world, that hath such people in it.” After four years of playing defense to
the Robert Ehrlich/Karl Rove assault on the rights of injured consumers, and oth- ers, the MTLA legislative team pursued an aggressive, multi-front campaign to ensure the right to fair compensation. What changed the Annapolis playing field was everyone’s recognition that we now have a governor willing to sign, rather than veto, consumer-friendly legislation. Your MTLA Legislative Committee ac-
tively supported or opposed 115 House and Senate bills this session, including
but not limited to 12 medical malprac- tice bills, 25 workers’ compensation bills, 19 bills expanding immunity, and a number of bills pertaining to injuries stemming from exposure to lead paint. When the smoke cleared, Governor
Martin O’Malley signed into law three important initiatives sought by MTLA. 1. First Party Insurance Bad Faith:
Affording policyholders a meaningful remedy when a homeowner or auto
carrier “forgets” its promise to “act like a good neighbor.” 2. Savings Clause: Allowing medical
malpractice victims, re-victimized by dismissals in the wake of Walzer vs. Osborne, to re-file their claims, notwith- standing that the statute of limitations may have run. 3. Voidable Release: Giving accident
victims, who made the uninformed choice to take a “quickie” settlement
