The firm’s Arbitration Group is headed by Partner Russell Thirgood, who works between offices in Sydney and Brisbane, and focuses largely on the resources and construction sectors.

Russell is a National Councillor for the Institute of Arbitrators and Mediators Australia and Director of the Australian Centre for International Commercial Arbitration. Since 2002, he has been the editor of ‘The Arbitrator and Mediator’, the nation’s most respected alternative dispute resolution journal and has assisted government in the drafting of policy and changes to legislation. Notable Legal Work
Recent arbitration matters include: (a) major arbitration for a large Indian company in relation to the development of one of the largest coal mines in the world;
(b) advising in an attempt to have a foreign arbitration award recognised in Australia and to enforce that award against assets that the resources company has in the jurisdiction;
(c) international arbitration in Mexico concerning the construction of an oil refinery and pipeline;
(d) advising on the negotiation and arbitration of claims arising from the design and construction of a crushing plant at a gold mine;
(e) acting for an Australian construction company against a Dutch dredging company in an International Chamber of Commerce arbitration heard in Hong Kong concerning a dredging contract in Corio Bay, Victoria. A multi million dollar award was secured together with compound interest and indemnity costs; and
(f) London Court of International Arbitration
enforcement proceedings in the Federal Court of Australia.
Outside of the firm’s arbitration work, it has recently achieved decisive victories for an international hotel group in numerous interlocutory injunction and related applications regarding termination of the group’s management agreement in respect of one of its Queensland resorts; has led significant pieces of litigation associated with the construction of the project infrastructure for large coal mines; and achieved a notable victory for a large fund manager in Federal Court proceedings brought by the Australian Securities and Investments Commission regarding a controversial asset sale program.
