How to manage your people – all you need to know in five golden rules
Considering how much employment legislation there is in the UK, perhaps it seems too simplistic to narrow down the guidance to five rules. However, these principles encompass a whole range of issues that arise during the employment relationship and can ease the way for you and your employees, writes Liz Iles, Senior Employment Consultant at Croner.
RULE 1: RECRUIT WELL AND CAREFULLY If you recruit well you may not need the other golden rules, as you are setting yourself up for a trouble-free relationship with your new employee.On the legal side, discrimination claims can be made even before employment starts and a careful and well- documented procedure will be good protection.On the practical side, recruitment is expensive, so getting the right person first time will save money as well as trouble further down the line.
RULE 2: HAVE A GOOD CONTRACT Make sure you have some form of legally compliant statement of terms and conditions, agreed and signed by you and your employees. This should be supported by an employee
handbook.These should set out the principles for the relationship you expect to have with the employee and underpin the evidence in any dispute.
RULE 3: CARRY OUT A THOROUGH INDUCTION The induction process is a good opportunity for you to assess the competence and ability to learn of your new employee.
Having an induction check list ticked off and signed by new employees, will avoid excuses later on.
RULE 4: TAKE TIMELY ACTION You have two years before an employee can claim unfair dismissal, so use that time to tackle any performance or general conduct issues. Have regular reviews where you can discuss any issues.
After these two years / in any event, deal with issues as they come up and don
t wait until they become a big problem.
RULE 5: BE CONSISTENT AND THOROUGH If you do have disciplinary issues to deal with,make sure you carry out a thorough investigation — no presumption of guilt, asking open questions, getting detailed signed and witness statements etc are all required by all Employment Tribunals. Additionally, you will need to demonstrate that you acted in a reasonable and consistent manner.
So there you have it — five golden rules to get you through the employment minefield!
