Facts: The plaintiff was rear ended while waiting to making a left turn onto Thawley Road from U. S. Route 404 in Caroline County, Maryland. The at-fault driver was an underinsured motorist with Allstate In- demnity Company.

Allegations of Liability: State Farm did not stipulate to liability and was unable to produce the at-fault driver at trial to seri- ously contest liability.


Injuries/Damages: The plaintiff had pre- existing spondylolisthesis which was aggravated by the accident and ultimately required surgery.

Allegations of Liability: pickup truck driver followed too closely, failed to keep proper lookout, and was in scope of employment with engineering firm while returning to office at 5:30pm.


Injuries/Damages: fractured left femur; permanently implanted rod/screws in femur; past medical bills $33,200; past lost wages $50,000; property damage: $6,500. no future economic damages claimed.
