Hello, and welcome to the World IP Review e-Digest 2013. Tis year’s edition features contributions from 23 countries and six leading intellectual property associations. Te Digest aims to provide a retrospective on developments in the last 12 months, and a look forward to the challenges that are likely to present themselves in the coming year.


Tis past year was an interesting one in the world of IP. Te America Invents Act took effect in the US, meaning some harmonisation with what might be termed global norms for patent law and significant changes to the statute. Time will tell how successful those changes are, especially when it comes to the impact of the first-to-file provision for patents, but the early signs are mostly positive.


In Europe, the long-awaited Unitary Patent and Unified Patent Court have been approved (though not yet ratified). It is less clear at the moment that these developments will be as successful as their authors want, but assuming they do eventually come into being, the change to practice in Europe will be profound.


Of course, what happen in Europe and the US is important, but it’s becoming ever clearer that other important nexuses for IP have developed. China continues to emerge as a leading jurisdiction, and indeed, recent Tomson Reuters research suggests that, along with Brazil, Russia, Korea and India, the emerging countries are fast catching up with the established G7 in terms of patents filed. It’s a similar story on the trademark side, though there remain concerns about the quality and enforceability of IP rights in some of those countries.
