Diputados aprueban proyecto de ley para loterías del sector privado
La Cámara de Representantes de Brasil aprobó, la semana pasada, un proyecto de ley que autoriza al gobierno federal a crear loterías de salud y turismo, que incluyen operaciones de apuestas deportivas físicas y virtuales que pueden ser explotadas por el sector privado. Según el proyecto de ley, parte de las utilidades
recaudadas serian para financiar el Fondo Nacional de Salud (FNS), en el caso de la Lotería de salud; y otra parte para la Agencia Brasileña para la Promoción Internacional del Turismo (Embratur). La propuesta tiene autoría del diputado Giovani Cherini, quien dijo: “Esta lotería será la mejor opción para pagar los salarios básicos de las enfermeras, bajo la gestión del Ministerio de Economía lo gestionará, que cuenta con una organización competente para esto, puede regular las operaciones, ya que todo estará dentro de la ley”. Cherini destacó que la Caixa Econômica Federal (CEF), que opera la lotería estatal más grande de Brasil, no está impedida de participar en el concurso para organizar la lotería. “Queremos abrir la posibilidad al sector privado”, agregó. En materia de participación de las utilidades, el
proyecto de ley establece que luego de las deducciones previstas por la legislación, los ingresos generados por las loterías de Salud y Turismo se distribuirán de acuerdo a criterios específicos para cada tipo de modalidad.
Las loterías de números:
El 5% se destinará al Fondo Nacional de Salud (FNS), en el caso de la Lotería de la Salud, o a la Agencia Brasileña para la Promoción Internacional del Turismo (Embratur), en el caso de la Lotería de Turismo, con el 95% para cubrir los gastos del operador.
Apuestas deportivas:
El 3.37% se destinará a la FNS, en el caso de la Lotería de salud, o a Embratur, en el caso de la Lotería de Turismo; 1.63% para entidades deportivas que autoricen el uso de marcas, emblemas e himnos para la difusión y ejecución de loterías, y 95% para cubrir los gastos del operador. En el caso de premios no reclamados por los ganadores dentro del plazo de entrega, estos se revertirán a la FNS o a Embratur, dependiendo del tipo de lotería. El texto también prevé un mecanismo especial de distribución mientras dure el estado de emergencia de salud pública por el Covid-19. La emergencia, sin embargo, fue revocada por el gobierno federal.
Explotación privada
La propuesta aprobada por los diputados establece que el Ministerio de Economía será responsable de las normas de concesión para la explotación de las nuevas loterías, las cuales deberán ser anunciadas dentro de los 30 días siguientes a la publicación de la ley. Según el representante Cherini, esto permitirá al sector privado explotar las loterías. En la primera versión aprobada por la Cámara, se pronosticó que solo Caixa Econômica Federal operaría loterías.

Representatives approve private sector lotteries and sports betting
Brazil’s House of Representatives has approved a bill authorizing the federal government to create health and tourism lotteries, which includes operations of physical and virtual sports betting that may be exploited by a private company. According to the bill, part of the profits collected will be destined to finance the National Health Fund (FNS), in the case of the Health Lottery; with another part for the Brazilian Agency for the International Promotion of Tourism (Embratur). The proposal was put forward by Rep. Giovani Cherini, who said: “This lottery will be the best option to pay the nurses basic wages. The Ministry of Economy will manage it, as it has a competent sector for this to supervise operations, so everything will be within the law.” Cherini highlighted that Caixa Econômica
Federal (CEF), which operates Brazil’s largest lottery, is not prevented from participating in the contest to organize the lottery. “We want to open up the possibility to the private sector,” he added.
On the matter of profit sharing, the bill states that after deductions provided for in the
legislation, revenue generated for the Health and Tourism lotteries will be distributed according to specific criteria for each type of modality.
Numbers lotteries:
5% will be allocated to the National Health Fund (FNS), in the case of the Health Lottery, or to the Brazilian Agency for the International Promotion of Tourism (Embratur), in the case of the Tourism Lottery, with 95% to cover the operator’s expenses.
Sports betting:
3.37% will be allocated to the FNS, in the case of the Health Lottery, or to Embratur, in the case of the Tourism Lottery; 1.63% for sports entities that authorize the use of brands, emblems and anthems for the dissemination and execution of lotteries, and 95% to cover the operator’s expenses. Prizes that are not claimed by the winners within the deadline
will revert to the FNS or to Embratur, depending on the type of lottery. The text also provides for a special distribution mechanism while the state of the public health emergency due to Covid-19 lasts. The emergency, however, was revoked by the federal government.
Private exploration
The proposal approved by the deputies provides that the Ministry of Economy will be responsible for the concession rules for the exploitation of the new lotteries, which must be published within 30 days after the publication of the law. According to Rep. Cherini, this will allow the private sector to explore lotteries. In the first version approved by the House, there was a forecast that only Caixa Econômica Federal would operates lotteries.
