La Superintendencia Nacional de Aduanas y de Administración Tributaria (Sunat) ha anunciado el inicio de cobranza a las apuestas deportivas y plataformas de e-sports en Perú con el objetivo de generar ingresos adicionales para el Estado, mediante un nuevo marco regulatorio.
El ISC, es un tributo diseñado para regular productos o servicios que pueden generar externalidades negativas, y tiene como objetivo principal desincentivar el abuso en las apuestas y mitigar posibles problemas sociales asociados con el juego compulsivo. Según la normativa, las apuestas deportivas y los e-sports no estarán sujetos al IGV, pero sí al ISC. La Sunat señaló que este enfoque permite abordar de manera más específica los riesgos sociales y económicos asociados a estas actividades. Al tratarse de un sector de rápido crecimiento, la regulación fiscal busca establecer un equilibrio entre la promoción de la actividad económica y la protección de los consumidores. Aunque las plataformas de
apuestas digitales no están sujetas al IGV, su inclusión bajo el ISC refleja un enfoque estratégico del gobierno para abordar diferentes sectores del mercado tecnológico. La norma dice que, “En conjunto, estas medidas permitirán un control más eficiente de los servicios digitales y fortalecerán la recaudación fiscal”.

PERU El ISC se aplicará a las apuestas deportivas
The National Superintendence of Customs and Tax Administration (Sunat) has announced the start of Impuesto Selectivo al Consumo (ISC) tax collection in sports betting and e-sports platforms in Peru with the aim of generating additional income for the State, through a new regulatory framework. The ISC, or Selective Consumers Tax, is a tax designed to regulate products or services that can generate negative externalities, and its main objective is to discourage abuse in betting and mitigate possible social problems associated with compulsive gambling.
According to the regulations, sports betting and e-sports will not be subject to IGV (Sales tax), but they will be subject to ISC. Sunat pointed out that this approach allows for a more specific approach to the social and economic risks associated with these activities. As betting and gambling is a fast-growing sector, tax regulation seeks to strike a balance between promoting economic activity and protecting consumers. Although digital betting
platforms are not subject to IGV, their inclusion under the ISC reflects a strategic approach by the government to address different sectors of the technology market. The regulation says that, “Together, these measures will allow a more efficient control of digital services and strengthen tax collection.”
