Solicitor involved in ‘dubious’ home sales


A SOLICITOR who became involved in “dubious” home sales was this week fined by his governing body, the Law Society, at a Disciplinary


Tribunal. Stephen Booth (53) arranged


a house sale from a pensioner to a long-standing client, who then sold the house for a 53% profit within days. He also acted in a conflict of interest and failed to tell a building society that i t was lending more than the purchase price of a house. Booth was briefly a partner


in the Clitheroe firm of Booth Moores, in Harris Court, Well- gate. However, that partner­ ship has since been dissolved and he now has no connection whatsoever with the well-estab- lished local firm of Ruth Moores and Co., based at the same address. The matters dealt with at


this week’s tribunal pre-date Booth’s time in Clitheroe and Ruth Moores has been fully exonerated by The Law Society of any involvement whatsoever. Mr Geoffrey Williams, QC


for the Law Society, told a Solicitors' Disciplinary Tri­ bunal: “All these transactions have dubious characteristics. By his actions he (Booth) facil­ itated the matters going for­ ward.” Mr Williams told how Booth acted for a “vulnerable” pensioner in her 70s, referred to as “Mrs B”, who owned a prop­ erty in Thorne Street, Nelson. She was selling her house for £6,500 to a property developer, referred to as “Mr F”, who w ^ an “established c lient” of Booth's. “He was buying the property


and immediately selling it for £10,000,” Mr Williams said. “Because he was acting for


the vendor and the purchaser it was mandatory that he had to have the written consent of both. He did not have that con­ sent. He did not disclose to Mrs B tha t Mr F was making a 53% profit on the sale. The vendor was entitled to the best price and in this case she was not getting it.” In another transaction in


Garden Street, Padiham, Booth acted for the buyer, who was selling the house to his sis­


ter. He also acted for the lender, the Halifax building society, but did not tell them that the buyer and seller were related. Less than a year later the brother sold the house back to the sister. In a transaction on a house in


Shakespeare Street, Padiham, in January 2003, Booth acted for all three parties. The mort­ gage, lent by the Halifax, was in excess of the £44,950 pur­ chase price, but Booth did not declare the fact to the building society as he should have done. Booth admitted failing to


disclose information to a client, acting in a conflict of interests and contravening written instructions. He was fined £5,000 and


ordered to pay costs, which will be assessed at a later date. He told the hearing he was


arrested on June 25th, 2003, and thrown into a cell at Pre­ ston police station in a Nation­ al Crime Squad investigation. “I was only questioned about


matters that arose when I was working as an assistant solici­ tor five years previously,” he said. This is the end of a two-


year nightmare which will probably never go away.” He added: “I do not believe I deserve this from the Law Soci­


ety.” Booth, of Heightside House,


Northtown, Padiham, said the suggestion had been made that he had taken advantage of a vulnerable and elderly client. He said: “I have always striv­


en to do my best for clients.” The tribunal heard that


Booth was now only working one day a week as a solicitor and was also employed by a civil engineering contractor. Tribunal chairman Mr


Andrew Spooner said: “This case involves serious issues. We are particularly concerned about Mrs B and her vulnera­ bility and the failure to posi­ tively advise her to seek sepa­ rate advice. “It is particularly important

Amie’s carriage driving earns national win


A FORMER pupil of Clitheroe Grammar School has won her first National Carriage Driving competition at the age of 19. Amie Woodward won the


event at Henbury Hall, Mac­ clesfield, where there were more than 100 competitors taking part in single, pairs, tandem and team competi­ tions. Amie has been involved


with carriage driving since she was 12, grooming for Jane Lamb, another National Sin­ gle Horse competitor, but this is her first season driving her­ self. As a member of the North


Eastern Driving Club, she has won at ' Thorseby Hall, Knowle Hill, Ripon and Rip­ ley Castle, enabling her to enter her first Novice Qualify­ ing event at Henbury Hall. Carriage Driving is held


over three days with three phases; dressage, marathon and cones. Amie came first in all three


phases, beating several drivers who are much more experi­ enced on the circuit than her­ self. The horse, Sheba, is an


Arab cross cob, broken for driving when she was three


years old. Now eight and experienced in competition, she has given Amie her first high level win. Some readers may well have


seen Sheba exercising around the roads of Clitheroe with her brother. Indy. The most exciting phase of


the three-day contest is the marathon, where competitors cover 1km. at walking pace within a time limit and then eight obstacles, which are all timed. Many of the obstacles chal­


lenge even the best drivers at Henbury Hall, none more so than the team drivers with four horses. After the presentation was


made, Amie said she was pleased with Sheba’s perform­ ance and looking forward to the next National event to be held at Alnwick Castle, in August. The win at Henbury Hall


now means Amie has qualified to take part in the national finals at Windsor Castle, in September. Our picture shows Amie and
