Ultraframe wins a second court fight
By Duncan Smith______
ULTRAFKAME, the Clitheroe- based conservatory giant, has won another court battle with an industry rival - the second in the space of a month. This time it was in dispute with
the Burnden Group Pic, which launched two legal actions alleging that Ultraframe (UK) Limited, an Ultraframe director and two wholly- owned subsidiaries of Ultraframe (N o r th s ta r and Seaquest) had
infringed Burnden's intellectual property rights. The complex case involved the
Burnden Group buying old intellec tual property rights in what Ultra
frame alleged was an attempt to restrict competition in the conserva tory market. Now the Court of Appeal has
ruled in favour of Ultraframe, dis missing both of Burnden’s action in them entirety. Burnden will therefore receive no damages in respect of the multi-million pound claims that it brought. Burnden is also expected to be ordered to pay Ultraframe's costs in this matter. This latest Court of Appeal judg
