CONDITIONS OF ACCEPTANCE OF ALL ADVERTISEMENT ORDERS


Orders for insertion of advertisements in the Burnley Express are accepted subject to the Standard Condition agreed between the Newspaper Society and the Institute of Practitioners in Advertising save that.

The proprietors accept no liability for any loss or damage caused by an error or inaccuracy in the printing of any advertisement.


> No liability is accepted for any loss or damage alleged to arise through delay in forwarding replies to box numbers, however caused. Particulars of the Standard


Conditions will be supplied on request.


If the material or layout of the advertisement, or any part of it is composed by the Proprietors at no extra charge to the advertiser, the copyright in the whole ad­


vertisement shall belong to the Proprietors. The following rules for the settlement of accounts will apply.


(a) The due date for payment shall be the last day of the month following the month of insertion of an advertisement or if the publisher shall not have despatched the appropriate invoice and voucher or other proof of insertion (or made the same available for collection when this is the custom) to the agency (or the advertiser if it is a direct account) by the 10th day of the month following insertion, the last day of the second month following the month of insertion;


(b) If any sum owing by the Agency (or the Advertiser if it is a direct account) to the publisher has not been despatched to the Publisher on or before the due date for payment the sum soowing shall immediately and without notice be increased by a surcharge equal to 3'76 of the gross rate charged by the Publisher before de­


duction of any Agency commission;


(c) If any sum owing by the Agency (or the Advertiser if it is a direct account) to the publisher (including the amount of any surcharge payable in accordance with paragraph (b) above) has not been despatched to the Publisher before the expi­ ration of one month after the due date for payment the sum so owing shall im­ mediately and without notice be increased by an additional surcharge equal to 2% of the gross rate charged by the Publisher before deduction of any Agency


commission. •


(d) The existence of a query on any individual item in an account will not affect the due date of payment of the balance of such account.


(c) In these conditions the word despatched shall mean despatched by post or by such other means as shall provide that payment shall have been received by the publisher not later than three working days from the dale appropriate thereto.


(f) A ll advertisements arc subject to I7l/:7r VAT.


(g) A ll transient advertisements are subject to a 25*^ surcharge it not paid within 14 days from the date of the invoice.


The terms of the Recognition Agreement between the Newspaper Society or be­ tween the Newspaper Society and the Newspaper Publishers Association and recognised advertising agencies arc deemed to be incorporated in these condi­ tions of acceptance of advertising orders or the publication of all advertisements


accepted from a recognised advertising agency;


Without prejudice to the generality of these terms these eoflJitions of acceptance specifically extend to any personal guarantee given by the Directors or any other tii-son on behalf of a recognised agency at the time of the recognition in respect


of any unsatisfied liabilities of the agency in the event of the agency s liquida­ tion or insolvency. Such guarantee is part of these conditions of acceptance.


The placing of an order for the insertion of an advertisement shall amount to an acceptance of the above conditions and any conditions stipulated on an agency s order form or elsewhere by an agency or an advertiser shall be void insofar as


they arc in conflict with them.


The Advertiser hereby grants to (Burnley Express) (the "Company") and all other mcni- bersof the Regional Indepcndant Media pic group (the "RIM Group ) a licence to use and publish the full format of the advertisements and other works and materials submitted b> the Advertiser for or on behalf of the Company or any RIM Group member or produced or acquired by the Advertiser for or on behalf ol the Company of any RIM Group mem­


ber (herein called "Works").


The Advertiser also grants to the Company and all other members of the RIM Group a perpetual, irrevocable, non-cxdusive licence to use and publish at any time without re­ striction:


(a) the full formal of all or any of the Works in archive form; and/or


(b) the text and/or the factual content of all or any of the Works (but not any accompa­ nying photographs or images or layout);


in whole or in part, as a single item or as part of a series or compilation, or otherwise, in any part of the world.


With respect to the licences granted in sub-clauses (a) and (b) above, the Company and/or other members of the RIM Group can use and publish the Works in any system, form or manner whatsoever whether or not such system, form or manner exa lt or ,s conkmplat. cU or envisaged al Ihc dale of this agreement including, but not limned lo. The Advertiser undertakes to procure that all suppliers are Involved in the creation of the Works authorise the Advertiser lo grant a licence on the terms set out in sub-clauses (a) and (b) and that such suppliers procure that the authors of the Works unconditionally and irrevocably waiver all moral rights droits morale and all other similar rights and lights having similar effect which lhay may have or may acquire in respect of the Works.
