MANCHESTER CITY COUNCIL PUTS BRAKES ON NEW HACKNEY POLICY


In an abrupt about-turn as sharp as the black cab’s famous turning circle, Manchester City Council has indicated that the adoption of new “Manchester Con- ditions of Fitness” for licensed hackney car- riages, having been discussed at length, will be going back to the drawing board. licensing. The existing TX4 does not currently come supplied with the requisite lip/ledge on the ramp to prevent wheelchair slippage, and the Mercedes will be required to have a swivel seat fitted at a prohibitive cost. Immediately following the 10 June Commit- tee, a solicitor’s letter was sent

council on behalf of Allied Vehicles, manu- facturer of the Cab Direct E7, reminding the council of the dis- tinct possibility of legal challenge of their poli- cy


following the


outcome of the case R on the application of Alma Lunt and Allied Vehicles Ltd –v- Liver- pool City Council, which upheld that Liv- erpool City Council’s hackney


licensing policy was unlawful


in that


carriage it


amounted to “unjusti- fied discrimination”.


Manchester City Coun- cil is now considering their position, and the outcome of the 2nd July Committee will be made known to PHTM readers as soon as we know it ourselves. Meanwhile, Manches- ter


licence holders


have told us that (a) on the 10th June the Com- mittee deliberated for 80 minutes over “legal matters” whilst licence holders and the public – and the licensing offi- cer - were excluded, whereas the trade believes this should be an open forum for dis- cussion.


(b) The


‘interim policy’ has now been extended until the new policy is determined. (c) Most significantly, at


this


point in time there are no vehicles licensed in Manchester which would adhere to all the new “Manchester con- ditions of
