The EU gets serious about shoring up its oversight, will we finally have a level playing field?
In the wake of the financial and subsequent economic crisis in 2008 and 2009, the EU put forward a package of rules and regulations to improve its oversight of the financial and banking sectors that operate on the EU market. Where there was little oversight before the financial sector is now grumbling about too many rules and regulation hampering their freedom to operate.
The automotive sector is facing a similar predicament as the reputational blow to the diesel engine power train technology is slowly becoming apparent. At the time of writing investigators are raiding company Head Quarters in France looking for fraudulent practices, large consumer organisations are announcing independent test programs of fleets of diesel vehicles of all makes and models, and the EU is coming under intense pressure to shore up its own expertise in the area.
That the EU can move fast is made apparent by the fact that its services have re-drafted the EU type approval directive in less than 3 months. Lightning speed for Brussels standards. Currently the proposal of which we have seen a leaked copy is going through its final review at the highest political level.
It will be no surprise to many that the regulatory oversight of the industry is getting shored up. Favouritism by certain type approval authorities to certain makes and brands driven by either national or financial interest are less likely in the future.
Ultimately this bodes well for all those companies who like to play by the rules and like to operate in a market that ensures a level playing field for all. Although our industry is one layer removed, this development greatly increases the outlook for our sector as well. Our case to obtain fair access to technical information as required under Euro 5 and 6 vehicle emission regulation just got better. Things are looking up for 2016!
Technical & Competition Committee The Technical Committee and the Competition Committee have issued 2 OEM Bulletins since the last Newsletter: • Aprilia (Piaggio) - October 2015 • IVECO S.p.A. - November 2015

The Technical Committee is currently investigating: • Industrial - 1 Case • Off Highway - 3 Cases • PCMO - 6 Cases • HDDO - 1 case
The first Technical Committee meeting of 2016 took place in Brussels, on 27 January 2016.
Taxation
Italy has formally requested the Presidency to include on the agenda of the next Excise Committee on 30 and 31 May the topic ‘inclusion of all lubes under EMCS’. More and more EU Member States seem to be willing to agree on the inclusion of all lubes under EMCS as tax authorities of certain EU Member States stated that fraud with lubes has allegedly increased in recent years (UEIL will investigate this matter to gather further evidence of these claims). The decision will be taken by qualified majority.
The UEIL position is against this proposal and therefore will increase its outreach activities to secure a blocking minority. Actions are already planned - don’t hesitate to contact us for further information.
UEIL 2016 ANNUAL CONGRESS
The UEIL 2016 Annual Congress of the European Lubricants’ Industry will take place in Berlin (Germany), between 26-28 October 2016!
