EU policy updates from the re-refining industry
Mobilising industry for a clean and circular economy lies among the key objectives of the EU Green Deal released in December 2019. In view of that ambition, the European Commission has presented a Circular Economy Action Plan (CEAP) in March 2020. In order to foster circularity in a toxic-free environment, the CEAP planned to amend the Annexes to the Regulation on Persistent Organic Pollutants (POPs).
These substances, which are still widely used in industrial processes such as re-refining, have the characteristic to persist for very long periods of time and accumulate, posing a threat to human health and the environment. On 28 October, the Commission published its proposal amending the annexes to the POPs Regulation in waste. This revision aims to meet the threefold objective of aligning EU legislation with scientific and technical progress, implementing EU’s international obligations under the Stockholm Convention as well as enhance recycling and circularity practices. Following the publication, EU Commissioner for Environment Virginijus Sinkevičius declared that: “removing persistent chemical substances in waste is essential to protect our health
and our environment. Ambitious limits for these substances are also needed to foster high-quality, toxic-free secondary materials that can be safely used in a growing circular economy”.
The European Parliament and the Council, as co-legislators, will now enter in negotiations to discuss the different limits laid down in the proposal. One could expect an agreement on a final text, including provisions affecting waste oil, around mid-2023. In the meantime, in view of the Green Deal ambition to head towards a zero-pollution goal for a toxic free environment, the proposal to revise the Classification, Labelling and Packaging (CLP) Regulation should be released in Q2 2022 and the proposal to revise the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) Regulation is due in Q4 2022.
