The Evidence Team is a cost-effective system for spotting and recording hazards and risk, with a one-off charge and no annual subscription. It moulds to fit your business and adapts to any changes or added processes, materials or functions. The system gathers specific timed and dated documentary evidence of hazards, their associated risk and preventative measures taken. It enables compliance with the principal health and safety (H&S) legislation including The Health & Safety at Work Act 1974 and the Law Reform (Contributory Negligence) Act 1945.


The law can accept recordings made on a mobile phone and video as documentary evidence, and speech is much easier and quicker than typing, especially on a mobile phone keyboard. These recording are automatically date and time stamped and can be e-mailed to the PC used by the person who is delegated with day-to-day responsibility for health and safety. By funnelling all records to a single point, the most qualified and experienced


H&S professional, it is expected that the best possible outcome can be realised.


The Evidence Team requires the delegated person to complete a description of the situation including due diligence questions and provides comparisons with how similar situations have been handled in the past. This helps general management discharge their overarching legal duty of care.


It is significant that criminal breaches of health and safety have often resulted in Chief Executives, Managing Directors and even Group Managing Directors being given custodial sentences.


The civil law outcome, using data from the Compensation Recovery Unit, shows that there are over 150,000 cases every year of successful claims for damages under Public or Employer liability. Whilst these are usually paid by insurance and under a Non-Disclosure Agreement, to prevent reputational damage, the cost and disruption, which can last for some years, is often considerable and therefore needs to be avoided. Reports and feedback from the Evidence Team can help mitigate this risk.
