vehicle to speak to the defendant about the sudden stop and whilst talking to him, they noticed his glazed eyes and slurred speech. A specimen for an analysis was
taken at the roadside, which gave a positive reading. Owen was taken to the police
station and after a toxicology report was taken, the lowest reading showed that the defendant had 63mcg of
alcohol in 100ml of his breath, exceeding prescribed limit. Defending, Diana Miller
apologised on behalf of Owen to the court and the police officers for their wasted time. Owen was said to have co-operated
fully with the officers at the time of the incident and is ‘hugely remorseful for the offence’. Stating that the defendant had two
pints of beer before driving, she said that Owen is a man that never usually drink drives. Ms Miller concluded by telling
Magistrates that she has ‘never met a man through her work who is more ashamed and aware of the dangers of drink driving as the defendant’. Explaining to Owen that they
accepted his complete remorse, Magistrates imposed a 17 month driving disqualification for the offence and endorsed his licence. In addition, Owen was ordered to
pay a fine of £320, a surcharge of £32 and prosecution costs of £85.
