In accordance with Title 24 CFR 58.70 and 58.45, this notice shall satisfy procedural require- ments for activities to be undertaken by the City of Detroit.
REQUEST FOR RELEASE OF FUNDS
On or about December 3, 2010, the City of Detroit will submit a request to the U.S. Depart- ment of Housing and Urban Development (HUD) Detroit Field Office for the release and cer- tification of Federal funds under Title I of the Housing & Community Development Act of 1974 (PL 93-383). The City of Detroit will use these funds for the following programs:
Lead-Based Paint Hazard Reduction Program
2010 – 2011 Community Development Block Grant (CDBG) Funds $750,000
Minor Home Repair Program
2010 – 2011 Community Development Block Grant (CDBG) Funds $3,900,000
Senior Emergency Home Repair Program
2010 – 2011 Community Development Block Grant (CDBG) Funds $3,000,000
SCOPE OF PROGRAMS Lead-based Paint Hazard Reduction Program
The Lead-based Paint Hazard Reduction program will provide funding for risk assessments, inspections, interim controls, and lead-based paint remediation in residential structures. Prop- erties eligible for financial assistance must meet the following conditions: 1.) be detached, single-family residential structures or one- to four-unit rental structures, 2.) not be located in a floodplain, 3.) have children under the age of six (6) or a pregnant woman in residence, and 4.) be occupied by residents who meet income eligibility requirements for total household income as established by the U.S. Department of Housing and Urban Development.
The program presents awards to eligible properties in the form of a matching forgivable loan/ grant. The maximum award is twenty-four thousand, nine hundred and fifty dollars ($24,950) per unit. The Planning and Development Department is the sole determinant of the amount awarded for each approved property participating in the program, and the City of Detroit will prioritize funding to structures where children with an elevated blood lead level (EBLL) of 10 ug/dl or more reside.
Minor Home Repair Program
The Minor Home Repair Program provides funding for lead hazards and minor housing re- habilitation activities that address health and safety concerns. Properties eligible for finan- cial assistance must meet the following conditions: 1.) be detached, single-family residential structures, 2.) not be located in a floodplain, 3.) need structurally and economically feasible repairs, 4.) be located within the target boundaries of a Sponsoring Community Organization (See Attachment A), and 5.) be owned by a person who meets income eligibility requirements for total household income as established by the U.S. Department of Housing and Urban Development.
The program presents awards to eligible properties in the form of a one-time forgivable loan/ grant. The maximum award for structures with occupant health and safety concerns is twenty- four thousand, nine hundred and fifty dollars ($24,950). The responsible entity will require the performance of housing inspections and risk assessments for potential health and safety concerns. The Planning and Development Department is the sole determinant of the amount awarded for each approved property participating in the program.
Senior Emergency Home Repair Program
The Senior Emergency Home Repair program will provide funding for emergency housing rehabilitation and repair activities to arrest and correct housing conditions that present health and safety concerns. Properties eligible for financial assistance must meet the following con- ditions: 1.) be detached, single-family residential structures, 2.) not be located in a floodplain, 3.) need structurally and economically feasible repairs, 4.) be owned by a person who is sixty- five (65) years or older OR fifty-five years or older and living with a physical disability, and 5.) be owned by a person who meets income eligibility requirements for total household income as established by the U.S. Department of Housing and Urban Development.
The program presents awards to eligible properties in the form of a grant. The maximum award for structures is twelve thousand dollars ($12,000). The responsible entity will require the performance of housing inspections for potential health and safety concerns. The Plan- ning and Development Department is the sole determinant of the amount awarded for each approved property participating in the program.
DETERMINATION AND FINDINGS
These activities are Categorically Excluded from further environmental review under Title 24 CFR 58.35(a)(3)(i), and the preparation of an Environmental Assessment or an Environmental Impact Statement is not required. In accordance with Title 24 CFR 58.38, the City of Detroit has prepared an Environmental Review Record that documents the environmental review of each of the above-named programs, and the City of Detroit finds that these programs will result in no significant environmental impact. The Environmental Review Record for each pro- gram is on file with the Planning and Development Department at 65 Cadillac Square, Suite 1200, Detroit, MI 48226. The records are available for public examination and copying, upon request, on weekdays from 8:30 a.m. to 4:30 p.m.
PUBLIC COMMENTS
The City of Detroit invites all interested agencies, groups and persons disagreeing with the environmental review findings to submit written comments for consideration. All submissions should identify the specific program as the subject of the comments. The Planning and Devel- opment Department should receive such written comments at the address listed at the top of this notice on or before December 2, 2010. The City of Detroit will consider all such comments so received, and the City of Detroit will not request the release of Federal funds or take any action on the above-named project prior to December 3, 2010.
RELEASE OF FUNDS AND CERTIFCATION
The City of Detroit will undertake the programs described above with Federal funds from the U.S. Department of Housing and Urban Development (HUD). These funds are provided under Title I of the Housing & Community Development Act of 1974 (PL 93-383). The City of Detroit certifies to the HUD Detroit Field Office that the City of Detroit and Mayor Dave Bing, or other official approved by HUD, in his official capacity as Mayor, consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that, upon its approval, the City of Detroit may use the Community Development Block Grant funds, and HUD will have satisfied its respon- sibilities under NEPA and related laws and authorities.
OBJECTION TO RELEASE OF FUNDS AND CERTIFICATION
The U.S. Department of Housing and Urban Development (HUD) will accept an objection to its approval of release of funds and acceptance of the certification only if the objection is based upon one of the following claims identified in Title 24 CFR 58.75: (a) That the certification was not in fact executed by the chief executive officer or other officer of the applicant approved by HUD; (b) That the applicant’s environmental review record for the project indicates omission of a required decision, finding, or step applicable to the project in the environment6al review process; (c) The grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is un- satisfactory from the standpoint of environmental quality. HUD will not consider objections to the release of funds on a basis other than those stated. Nor will HUD consider objections received after December 20, 2010.
All interested agencies, groups or persons must prepare and submit objections in accordance with the required procedures outlined in Title 24 CFR 58.76 and must address those objec- tions to HUD at the Detroit Field Office, Patrick V. McNamara Federal Building, 17th Floor, 477 Michigan Avenue, Detroit, Michigan 48226.
