NEWS Update variety protection I


n Mushroom Business no 60 of August 2013, the establishment of a working group has been announced directed to a better protection of new button mushroom varieties. Since that time progress has been made and this short note will give an update. The group has been extended and consists now of the spawn pro- ducers Sylvan, Amycel, Limgroup, Lambert Spawn, and the research groups INRA Bordeaux and Plant Breeding Wageningen UR. The spawn companies represent at least 75% of the European spawn market.


As stated in the previous article in Mushroom Business, the Euro- pean Union law system allows the protection of mushroom varieties by Community Plant Variety Rights (CPVRights), and for several mushroom varieties protection has been granted in the past years. In this system, copies are clearly defined as infringements of the Intellectual property of the holder of the rights. The main hurdle at this moment for investments in new button mushroom varieties is

the ease with which derived varieties can be generated via screening of single spore cultures. The working group has reached a consensus on the definition of the generation of essentially derived varieties (EDV) via this method. Each party of the working group has published a signed copy of the position paper on its website (for an example see http://www.wageningenur.nl/en/newsarticle/New-button-mush- room-varieties-need-better-protection.htm). The working group has now started to investigate how to extend the definition of EDV for other methods (and other mushroom species) similar to what has been done for several plant crops.


More support is welcome


The working group has also sought support in the mushroom indus- try for this position paper and a number of parties within the Euro- pean mushroom industry have signed a supportive letter. This is not only important to show the authorities as UPOV and CPVO that the concept of EDV is broadly supported but also relevant when infringe- ments are brought to court. If companies are willing to support this initiative and have not done so, please contact Anton Sonnenberg (anton.sonnenberg@wur.nl).

A mistake has crept into the article ‘Mushrooms in Puerto Rico’, on page 10 of Mushroom Business 69, top right sentence. Where it says: ‘..than the dry bulb in the room…’, it should read: ‘than the wet bulb in the room…’
