Catch as Catch Can by

Attorney Krysia Nelson

arah was an experienced horseperson who was visit- ing her elderly father. She was getting him something out of the kitchen when she looked out the win- dow and saw several loose horses run by. She then noticed a lot of people and some vehicular traffic headed in the same direction as the horses had gone. Sarah knew, from prior visits, that the loose horses belonged to her father’s elderly neighbor.

Sarah went out to her truck and

grabbed some lead ropes that she kept there, ready for such occasions. She then walked up the road to as- sist those trying to catch the horses. Sarah recognized one of the horses as a mare she had previously caught and returned to the neighbor’s property. On this occasion, the capture did not go smoothly, and Sarah was injured by the mare in the process of catch- ing and restraining her. Sarah sued her father’s neighbor, the owner of the mare. Does Sarah have a case?
