EPA’s Proposed Clean Water Act Rule
On March 25, the EPA posted a proposed rule that expands the Clean Water Act on their website. Later, on April 21, the EPA pub- lished the rule in the Federal Register, which triggered a 90 day public comment period.
Very problematic for the home building industry, the proposed rule has expanded EPA’s jurisdiction by changing the definition of “tributary” to include roadside ditches, irrigation ditches and stormwater ditches as well as other man-made conveyances that drain or connect. The NAHB, along with a coalition of other advocacy groups, are hard at work in Washington pressuring Congress to enact legislation that would prevent EPA’s rule from moving forward.
Here in Houston, the GHBA Developers Council will dedicate the May 7 meeting to reviewing this rule and its implications. The meeting will be held at 1:30 p.m. at the GHBA. If you are interested in learning more about the rule, please attend.
