Beware: employment law changes 2014


Employment law is renowned for constantly being updated and amended and 2014 is no exception, with further changes already under way for 2015. Many of the changes are a continuation of the Government’s policy of trying to simplify employment law to boost economic growth. Julie Taylor, head of employment at solicitor firm Gardner Leader LLP, highlights some of the key changes that could impact your business


ACAS mandatory conciliation


The CMI is the only chartered professional body for management and leadership dedicated to improving managers’ skills and growing the number of qualified managers. With a member community of 100,000 managers and leaders, it promotes high standards of ethical practice and helps managers build their expertise through online networks, regional events and mentoring opportunities.


Gaining CMI accreditation is further success for TVT&D, which is a subsidiary company of Bucks New University, and follows hot on the heels of the training accreditations it has secured with CILEx (Chartered Institute of Legal Executives), and AAT (Association of Accounting Technicians).

TVT&D will now provide CMI training in the Level 3 Certificate in First Line Management and Level 5 Certificate in Management and Leadership.

In addition to the new CMI courses, TVT&D provides professional training in the areas of IT, law, accountancy and finance, business, and sales and marketing, to both individuals and organisations. Courses are taught at its premises at Bucks New University's High Wycombe campus and in Slough, with some available for in-house delivery.


From April 6, 2014, employees wishing to make a claim against their employer will first have to submit the details of the dispute to the Advisory, Conciliation and Arbitration Service (ACAS). If a settlement cannot be agreed within one-month then the employee can take the matter to the employment tribunal.


Financial penalties


From April 6, 2014, employment tribunals will have new powers to impose financial penalties on employers who lose cases at the employment tribunal. The penalty could be up to 50% of the financial award made to the employee, although if imposed would be a minimum of £100 and up to a maximum of £5,000.


Equality Act amendments

Currently, under the Equality Act 2010, employees who believe that they have suffered discrimination in the workplace have the option of serving a “discrimination questionnaire” on their employer who is then obliged to respond within eight weeks or risk assumptions being made regarding their lack of response. The relevant provisions of the Equality Act facilitating this formal questionnaire process will be abolished on April 6, 2014.


Flexible working


The right to request flexible working is due to be extended to all employees with over 26 weeks continuous employment from April 6, 2014. This means employees

will no longer have to have caring responsibilities to be eligible to apply for flexible working and businesses will have a duty to consider all requests reasonably.


Shared parental leave


A new system of shared parental leave is expected to be introduced in 2015 which will allow eligible parents to share the maximum 52 weeks leave (including the 37 of the 39 weeks paid leave) between them.


Keeping up with employment law changes can be a headache for businesses. But putting in place measures now to prepare for these changes ahead and knowing your rights when it comes to employment claims, will help to ensure these headaches do not turn into legal nightmares.
