Rules and regulations of tax relief

PAUL HEAVEN, managing director of Blue Sky Corporate Finance, explains the importance of Entrepreneurs’ Tax Relief

E

ntrepreneurs’ Tax Relief (ETR) was introduced in 2008 to help the owners of small businesses who would otherwise be faced with hefty Capital

Gains Tax (CGT) bills when they sold their businesses. Beneficial to business people with small companies, ETR enables many entrepreneurs to pay just ten per cent CGT when they sell the assets they created. The ETR allowance of £10 million of capital gains is a life time limit so an individual can make a number of disposals of businesses during his lifetime but may not exceed this limit if they are to benefit from ETR. ETR is available to individuals and some trustees of settlements but it is not available to companies and personal representatives of deceased persons. You must also have owned the shares in the business for one year before the date your business was disposed of, or on the date your business ceased. The conditions for relief differ slightly if you are a sole trader, a partnership or an investor in a limited company. There are all sorts of rules and regulations and

‘ETR is available to individuals and some trustees of settlements but not to companies’

that’s why it is important to speak with someone who understands this form of tax relief.

Eyeing new markets

Nearly 60 per cent of entrepreneurs in the West Midlands are looking to expand into overseas markets in 2012, according to research from RSM Tenon. Over 40 per cent of business

owners questioned said that increased opportunities internationally would be an important factor in improving entrepreneurship in the UK during 2012. Stephen Newman (pictured),

the West Midlands head of international at RSM Tenon, said: “West Midland companies that are exporting are amongst the most successful at the moment. The majority are looking to Western Europe as a main source of growth in 2012, and growth areas will not just be in goods and services, 12 per cent of entrepreneurs said they will grow by acquiring overseas businesses. It’s interesting that despite the crisis in the Eurozone many entrepreneurs see their businesses expanding into Europe over the next year.” The findings were released in RSM Tenon’s ‘Lonely at the Top: The

Entrepreneurial Challenge Report’. It asked leading entrepreneurs about the different challenges and issues they face in today’s entrepreneurial Britain. Unsurprisingly, the highest number of entrepreneurs looking to expand

overseas was based in London (68 per cent). The West Midlands came second with 58 per cent, followed by the North East with 52 per cent. Just under half of the UK entrepreneurs said that Western Europe is the

area that they expected to expand into, and this was followed by Eastern Europe at 37 per cent and North America at 35 per cent.

Chase to boost school enterprise

Chase Chamber of Commerce will be working closely with Young Enterprise in 2012 to establish links and deliver enterprise education into schools in the local area. Young Enterprise is the UK’s

largest business and enterprise education charity. Every year it helps 250,000 young people learn about business and the world of work in the classroom under the guidance of volunteers from 3,500 companies. To be able to deliver this

successful enterprise education into school, Young Enterprise relies on volunteer support from the business community. Volunteers are needed to help deliver workshops into schools and also to act as business advisers for teams on the Company Programme. If you are interested in finding out

more and perhaps getting involved, visit the Young Enterprise website at www.young-enterprise.org.uk or contact the local Young Enterprise Manager, Simon Jenkins, on simon.jenkins@young- enterprise.org.uk or 07960 049372.
