2000 Federal Custody and Control No Longer Valid Beginning December 1, 2011, use of the expired Federal CCF


is considered a flaw that requires a memorandum for record. As of that date, laboratories were required to use the following procedures for federally regulated specimens received with the expired Federal CCF: the laboratory processes the specimen using its standard operating procedures for regulated specimens and contacts the collector for a memorandum explaining the use of the incorrect form. Te laboratory retains the specimen for at least 5 business days from the date that action is initiated to correct the CCF issue, and reports the specimen results upon receipt of


the collector memorandum. If the laboratory cannot obtain a memorandum from the collector, the laboratory reports a rejected for testing result and indicates the reason for rejecting the specimen on the report to the Medical Review Officer (MRO).


Collectors Reminded of Requirement to Distribute MRO Copy of CCF DOT’s Office of Drug & Alcohol Policy & Compliance recently


issued a reminder to reiterate that it is very important for collectors to send Copy 2 of the CCF to Medical Review Officers (MROs) in an expedient, legible manner. According to 49 CFR Part 40 [40.127 & 40.129], an MRO cannot report negative and non- negative verified drug test results to employers without first having Copy 2 of the CCF, a legible copy of it, or any other CCF copy containing the employee’s signature. And, if collectors fax CCFs to MROs, those faxes must be legible. Also, collectors must provide legible copies of CCFs to MROs and DERs within 24 hours of the collection or during the next business day; and collectors must keep Copy 3 of the CCF for at least 30 days [40.73]. ❚
