In this civil matter arising from the breach of a commercial lease, the trial court held a witness in direct contempt for testifying falsely under oath and ordered the witness held in jail for 10 days. On appeal, the witness argues that the sanction was too severe given that the trial continued in an orderly fashion. Further, the appellant argues that the trial court necessarily relied on deposition testimony and affidavits to make the finding of contempt and, therefore, the contempt was not entirely direct. Finally, the appellant argues that he should have been provided the opportunity to obtain criminal defense counsel as requested before his sentencing.
