Despite our recent success, the national statistics still hold. We lose over eighty percent of medical malpractice cases that we take to trial. One final thought: If a Mediation is to be successful


neither side is going to be particularly happy. You are going to take less than the lowest number that you entered the Mediation thinking you would take. On the other hand, the defendant(s) will pay more than the highest number they came to the Mediation expecting to pay. Tis, by definition, is a good settlement and a successful Mediation. Bernhardt, U.S. Court of Claims. Later, he defended physicians, hospitals, HMO’s and other health care providers as lead trial counsel and professional malpractice practice group leader for seventeen years, but has represented plaintiffs exclusively in medical malpractice claims since 1998. He also served as Chairman of the Professional Malpractice Committee and Judicial Selections Committee for the Maryland Association of Defense Trial Counsel and Peer Review Committee of the Attorney Grievance Commission of Maryland. He is currently a member of the Trial Lawyers Association of the District of Columbia and serves on the Board of Governors. He is a frequent speaker on medical malpractice, trial tactics and mediation issues for MAJ, TLA-DC and various physician, hospital, HMO and lawyer groups. In 2006, he was named “Trial Lawyer of the Year” by TLA-DC. He has been listed each year for the past several years in Best Lawyers in America, Super Lawyers in Maryland and Super Lawyers in the District of Columbia.
