“To get this information, ask the company for a
copy of the statute that grants them eminent domain power. Find out if the company is validly registered with the State Comptroller’s offi ce as having eminent domain power. If the pipeline company claims eminent domain power because it is a common carrier pipeline (a pipeline-for-hire), request evidence supporting its common carrier status. “For transmission lines, obtain a copy of the com-
pany’s Certifi cate of Convenience and Necessity from the Public Utility Commission. It explains what con- demnation power the company has and may provide additional information about the proposed project.” Lashmet says a landowner dealing with a company
that does not have eminent domain power “is in a much stronger negotiation position. In that case, if the com- pany does not agree to the landowner’s terms, it may not legally acquire the easement.”
Wind energy reservation Thousands of wind turbines are in the forecast for
future energy production across much of Texas, New Mexico and Oklahoma. Some ranchers feel they are a nuisance. But many more appreciate the lease payments
they receive from wind power companies, Clift says. “In general, these turbines are making about $10,000 annually,” he says. We’re seeing more wind energy reservations, or royalty reservations, in purchases. “The royalty off the turbine energy production is
believed to be transferable. The ranch owner can keep the wind (royalties) throughout the lease period — but it may cost the owner 5 to 15 percent of the land value if the property is sold.” Clift says that some ranchers don’t want any added
activity on their land. They may think twice about a new easement or lease. “There are cow-calf guys who are nervous about other people having access to the ranch,” he says. “Power line companies pay them a nice fee for the easements. But if you’re a cow-calf producer, you may want to protect against vandalism and traffi c on your property.” So if you want to expand your pasture needs, know
what the land includes besides grass and other natu- ral resources. Pipelines, power lines and other energy production or transmission structures may have an impact on the price. Make sure you know the ins and outs of easements. And, get a lawyer.
