the pipeline company obtains an easement from the landowner. “Although the monetary compensation is certainly an important factor for a landowner to con- sider, the nonmonetary terms of the easement may, in some cases, be more important and more valuable,” she says. “It is critical to include any statement or promise made by the company in the written easement agree- ment, or it will likely not be enforceable.”
Who has eminent domain? Lashmet says that before beginning negotiations,
determine whether the pipeline company or power line company has eminent domain power. “An entity holding power of eminent domain has the right to take private property for a public use upon payment of ad- equate compensation to the landowner, even without the landowner’s consent,” she says.
