Managing Emerging Exposures The Act creates new exposures for healthcare organizations.

It’s very important, as clients enter into these ACO arrangements, to make sure we’re covering things that they need to have covered.

Bradley Cox, Lexington Insurance Company

Risk managers must stay on top of new exposures emerging from the Act.

One example is the additional cyber-risk exposure in day- to-day operations, as providers move confidential patient information from one computer system to another through the use of electronic health records. Data errors in those records have the potential to invite dangerous medical errors.

It’s also unclear exactly what risks providers will be assuming in their contractual relationships as they create and operate as ACOs. To ensure that coverage needs are met, risk managers must communicate clearly about the structures they are creating and the agreements they are putting in place.
