Presented by: The Act and Tort Reform The Act promotes demonstration projects to test new approaches to civil litigation.

I think it will be evolutionary, but not revolutionary. Jim Kennedy, Carlton Fields

The Act promotes state demonstration programs to evaluate alternatives to the current civil litigation system for resolving disputes about injuries allegedly caused by healthcare providers or organizations. While the law indicates pilot projects should be designed in consultation with “all stakeholders,” it will be very difficult, if not impossible, to address the diverse interests of medical liability insurers, healthcare providers and attorneys, as well as patients and patient safety advocates. A more meaningful alternative to state-driven proposals might be an initiative from the federal government as part of a regulatory scheme that implements the Act’s various safety and quality protocols.
