Brent Cooper, of Cooper and Scully, P.C., the court upheld the application of the 10-year rule in this case because Ms. Rivera, the plaintiff, did not ex- ercise diligence in bringing the case. He says the court has not yet decided whether the 10-year statute would ap- ply to all cases involving minors, and physicians should err on the side of caution and continue to keep records of all minor patients for two years af- ter the patient’s 18th birthday. For adult patients, the court has


ruled that the 10-year statute is con- stitutional, and it is safe to dispose of medical records after 10 years, Mr. Cooper says. However, he adds, the case involving Ms. Rivera was a nar- row decision, and the court has not ruled on the constitutionality of the statute for all cases involving minor patients. n
