La nueva ley determina que del 100% recaudado por concepto del Impuesto a los Juegos, el 40% de la recaudación será destinado para el desarrollo del turismo, 20% para promoción de la salud mental, 20% al desarrollo del deporte, y 20% al tesoro público. La Ley que regula la explotación de los juegos y apuestas
deportivas a distancia indica que el Mincetur es la autoridad administrativa a nivel nacional que regula, autoriza, revoca, fiscaliza y sanciona la explotación de los juegos a distancia y apuestas deportivas a distancia. Esto fue destaco por el presidente Pedro Castillo. Respecto al caso de la fiscalización de las plataformas
tecnológicas, esta se realizará por accesos físicos y/o lógicos, presenciales o remotos. El texto dicta, igualmente, que se prohíbe la participación en los juegos y apuestas deportivas a distancia de los menores de edad y personas con ludopatía, identificadas a través del Registro de Personas Prohibidas a Acceder a Juegos de Casinos y Máquinas Tragamonedas. En el caso del otorgamiento de licencias de funcionamiento a
locales físicos, las municipalidades únicamente podrán otorgar licencias a los titulares de salas de juegos de apuestas deportivas a distancia previa autorización por el Mincetur. La ley también establece que las salas de juego de apuestas deportivas a distancia no deben encontrarse a menos de ciento cincuenta metros, siguiendo el mínimo recorrido peatonal, de templos o centros de educación en donde se imparta educación básica regular. Del mismo modo, se instituye la constitución de garantías a
favor del Estado para cubrir el pago de multas y premios, además, se plantea un impuesto directo aplicado al Ingreso Neto (Net Win) del 12% (mismo porcentaje que la actividad de casino y máquinas tragamonedas), entre otros.
BRASIL Senado planifica aprobar ley de juegos de azar en diciembre
Para nadie que conozca los artilugios políticos de cualquier país es noticia lo que dice el expresidente del Senado, David Alcolumbre, relator del proyecto de ley para juegos de azar, PL 442/91, que la Cámara aprobaría la ley de casinos en diciembre, después de las elecciones generales de octubre, cuando Bolsonaro sería derrotado por el expresidente Lula. Según el senador Alcolumbre, después de que el Senado se
haya sentado por meses sobre el PL, para legalizar casinos, bingos, y la ubicua lotería ilegal Jogo do Bicho, además del juego online, tras su aprobación en la Cámara de Diputados, este propondría el debate sobre la ley en el orden del día de la Cámara de Senadores, tras las elecciones de octubre. Según el plan del senador, en diciembre, antes del receso
parlamentario, el PL seria aprobado por la Cámara, y enviado al presidente Bolsonaro, quien vetaría el PL para no tener problemas con su fanática base de evangélicos, y lo devolvería al Congreso, el cual, siguiendo el proceso legislativo, revocaría el veto del presidente, para aprobar la ley de casinos, y hacer negocio como Dios manda. Es decir, tal como o hemos estado diciendo por meses, el negociado de casinos en Brasil empezara después de las elecciones de octubre, porque ya existen preacuerdos de inversión de políticos de turno facilitando multimillonarias inversiones de empresas de casino en Brasil, ¡gane o pierda Bolsonaro!

The Law regulating the exploitation of remote sports games and
bets sets out that Mincetur is the administrative authority at national level to regulates, authorize, revoke, supervise and sanction the exploitation of online remote games and sports bets at a distance, as was highlighted by President Pedro Castillo. Regarding the case of the control of technological platforms, this will be carried out by physical and / or logical access, face-to-face or remote. The text also determines that the participation in remote sports games and bets of minors and people with gambling problems, identified through the Registry of Persons Prohibited from Accessing Casino Games and Slot Machines, is prohibited. On the matter of granting of operating licenses to physical
premises, the municipalities may only grant licenses to the owners of remote sports betting game rooms with prior authorization by Mincetur. The law also establishes that remote sports betting gambling halls must not be less than one hundred and fifty meters away, following the minimum pedestrian route, temples or education centres where regular basic education is provided.
In the same way, the Constitution of Guarantees in favour of
the State has been instituted within the law to cover payment of fines and prizes. Also, a direct tax of 12% applied to the Gross Gaming Win (GGR), the same percentage as the activity of land-based casinos and slot machines, among others, has been proposed.
BRAZIL Senate plans to approve gambling law in December
For anyone who knows the political goings on of any country, what the former president of the Senate, David Alcolumbre - proponent of gambling bill PL 442/91 - says is that the Senate would approve the casino law in December, after the general elections in October, when Bolsonaro is likely to be defeated by former President Lula. According to Senator Alcolumbre, the Senate has archived for months PL442/91 to legalize casinos, bingos and the ubiquitous illegal lottery Jogo do Bicho as well as online gambling, after its approval in the House of Representatives in February. He said that he would be scheduling debating the law after the October elections. According to the senator’s plan, the gambling bill would be
approved by the House in December, before the parliamentary recess, and sent to President Bolsonaro for signature. However, as he would veto the PL to avoid problems with his fanatical evangelical base, he and would return the bill unendorsed to Congress. Then, according to the legislative process, Congress would revoke the president’s veto and approve the casino law, so that everyone can go ahead with plans to do business in the new gaming industry. Exactly as we have been saying for months, negotiation of casino
business in Brazil would begin after the October elections because there are already pre-agreements of investment where politicians already have endorsed multimillion dollar investments of casino companies in Brazil, with or without Bolsonaro!
