A LORRY driver from Ciit heroe who'was shown on YouTube driving along, a motorway unaware of a car trapped in front of his cab has been told he can keep his li cence. - In fact, John Tomlinson was
praised for being “cool and calm” in a crisis during a hearing before
North West Traffic Commission- ■ er Beverley Bell, who said he had no,way of knowing the car was there. •
The incident attracted interna
tional publicity when it was filmed . on a mobile phone by a passenger in a passing car and later upload ed onto internet video-sharing site YouTube. It was viewed by more than half-a-million people around the world and screened on internationalTV news chan nels. West Yorkshire Police, who
investigated thejiricident on the A1(M) near Wetherby in Janu ary, had already'decided to take no action against Mr Tomlinson following advice from the Crown Prosecution Service.' ■ However, Mr Tomlinson was
also summoned to appear at an investigative hearing before North West Traffic Commission er Beverley Bell at Warrington. She had the power to take away Mr Tomlinson’s LG'V driving licence, but ruled that he could keep it because he could not see, hear or smell the car. ^ Instead she described the car driver’s manoeuvre as “ill-ad vised” and praise’d Mr Tomlinson for remaining ffcool and calm” when he realised what had hap pened.
'ji- Mr Tomlinson’s solicitor, Mr
Sean Joyce, told the liearing that the driver of the Renault Clio car, Rhona Jane Williams, was join-
JOHN TOMLINSON
ing the southbound carriageway of the A1(M) when the incident happened at around 8-30 a.m. on January 13th. Because the merging slip road
joins the middle lane of the mo torway, she was effectively under taking the 44-tonne tanker. ■ Ms Williams, who is a vet from
York, told police she felt a bump as the rear driver’s side corner of her car touched the front offside corner of the lorry cab, turning her car through 90 degrees so that it became lodged sideways in front of the lorry. Because the car was well below
his line o f sight, Mr Tomlinson did not know it was there and continued driving until a motorist began Hashing his hazard lights: He brought his lorry to a stop
on the hard shoulder and only became aware of Ms Williams .

in' the Renault when he got out of his vehicle. He had to reverse his lorry a few feet to release the car and its driver, who was very shaken but unharmed. After hearing the evidence,
the Traffic Commissioner told Mr Tomlinson it was “absolutely clear” that he could not see Ms Williams’ car. .“What you found when you
pulled into the hard shoulder must have come as a complete shock and I think what you did, in reversing your tanker to release the Clio, was o f huge credit to you,” she said. “■You showed, in my view, cool
ness and a clear head. “I feel it is entirely inappropri
ate for me to take away your li cence.
“You, your employers and the
haulage industry should be able to hold your heads up high after this incident.” Ms Bell said the case illustrated
the dangers of lorry blind spots and urged haulage firms to fit close proximity mirrors on older vehicles, adding that it is now law for them to be fitted to new lor ries. Speaking after the hearing, Mr
Tomlinson, a lorry driver with 29 years’ experience, said the pres sure of the investigation was “in describable”. In a national newspaper inter
view at the time, Ms Williams told how she dialled 999 on her mobile phone as her car was be ing pushed along in front of the lorry. She told the Daily Mail; “I just
screamed at the operator T’m go ing to die. I’m going to die - can you do something?’ She tried to calm me down, but there wasn’t really anything she could do at the end of the phone.”
